**מתני' אלא בחרמו של ים.** דכתיב (קהלת ז׳:כ״ו) אשר היא מצודים וחרמים:

**הרי עצמי קרבן.** אסר עצמו כקרבן על חבירו:

**עונשין אותן ומחמירין עליהם.** בגמרא מפרש:

**פותחין לו פתח ממקום אחר.** כלומר שאלה צריך אבל לא עונשין ולא [נ"א אלא] מחמירין:

**גמ' בד"א בת"ח.** דקים לן בגוויה דלא משקר:

**אבל ע"ה שבא לישאל.** כלומר בא לפני החכם וא"ל כך נדרתי וכך היתה כוונתי כדי שיאמר לו החכם שאינו נדר וא"צ התרה:

**עונשין אותו ומחמירין עליו.** דלא מהימנינן ליה שכך היתה כוונתו ואינו בקי בתורת נדרים וירא שמא לא יוכל למצוא פתח שיתיר לו החכם ולכך משקר:

**דלא פתחינן ליה בחרטה.** לומר לו כדו תהית או לבך עליך:

**אלא עונשין אותו היכי דמי כדתניא כו'.** ולא שעונשין אותו יותר משאר נודר דדין זה הוא בכל נודר שעבר על נדרו אלא קמ"ל דאע"ג דלאו נדר גמור הוא עונשין אותו:

**לאו שפיר עבד.** דלא תימא כיון דחומרא בעלמא הוא אי עבר ועבד ביה לא גערינן ביה קא משמע לן דגערינן ביה ואמרינן ליה דלאו שפיר עבד ומיהו לא משמתינן ליה:

**אצל כהן עם הארץ שסופו להאכילך תרומה.** אבל משום טבל ליכא למיחש דמפריש תרומה ואכיל לה וכן מעשר מפריש ממנו תרומת מעשר ומעכב המעשר לעצמו:

**יראתו על פניכם זו הבושה.** שכל הירא מתבייש:
