**שלא ע"פ חכם.** ואין צריך שאלה אע"פ שכל פתח וחרטה עוקר הנדר מעיקרו ואעפ"כ צריך שאלה לחכם האי פתחא מוכחת טפי:

**משום דא"ל לאו כלבא אנא.** וכיון שיש טעם לדבר אמרינן דלנדר איכוון:

**דמתהנינא ממך.** דכיון שהוא רוצה שיקבל ממנו מתנה מרובה מסתמא גם הוא נהנה ממנו הרבה:

**לאו מלכא אנא.** ומסתמא ההנהו הרבה מאחר שתובע ממנו מתנה מרובה:

**זמינא הוא דאדריה למזמנא.** המזומן ביקש למזמן שיזמינהו לסעודתו וא"ל אין נדר זה עליך דאזמנית וא"ל המזומן למזמן מודרני מנכסיך אם לא אוכל אצלך כי רצו להזמינו גם לסעודה אחרת והוא חפץ יותר לאכול עם זה האיש ובכה"ג לא הוי נדרי זרוזין אלא לנדר גמור נתכוונו שניהם:

**מאי לאו אפי' בקמייתא [לא בבתרייתא].** אבל מהך ליכא למפשט דפליגי דשאני הכא כיון שאמר שאני נהנה לך בהאי פליגי רבנן משום דא"ל לאו כלבא אנא כו':

**הלכה כראב"י.** ומסתמא אמתני' קאי אלמא פליגי והלכתא כותיה:
