**גמ' לימא בהא קא מיפלגי.** רב ושמואל:

**נכסי אלו.** לאו דוקא והה"נ אם אמר נכסי דבכל ענין אדם אוסר דבר שברשותו אפילו לכשיצא מרשותו הלכך הא דקתני במתניתין ובשביעית אוכל מן הנוטות ע"כ איירי בנודר בשביעית והאי דנקט ר' יוחנן ור"ל נכסי לאו דוקא הה"נ נכסים אלו דבכל ענין אין אדם אוסר דבר שברשותו לכשיצא מרשותו הלכך הא דקתני במתניתין ובשביעית אוכל (אף) מן הנוטות איירי אף בשהדירו לפני שביעית:

**בחייו ובמותו לא יירשנו.** אלמא אדם אוסר נכסיו לאחר מותו אע"פ שיצאו מרשותו:
