**הנודר מן הירק.** והוא אומר לא מצאתי אלא דלועין. ואם מין ירק הוא למה לא לקחו:

**אמר להם כן הדבר.** ומשם אני מביא ראיה שמא אומר לא מצאתי אלא קיטנית אלא הוא אומר לא מצאתי ירק אבל על הדלועין הוא צריך לימלך אלמא מין ירק הוא:

**ודילמא ירק הנאכל בקדרה.** ע"י כבישת קדרה כדתנן האשה שהיתה כובשת ירק בקדרה ובלשון בני אדם יותר נקרא ירק מירק המתבשל בקדרה: ומשני שאמר בפירוש ירק המתבשל בקדרה:

**מודה ר"ע לענין מלקות שאינו לוקה.** דלחומרא אסר ליה כיון שהשליח נמלך עליו מ"מ כיון שאינו לוקחו בלא המלכה לא בריר לן שהוא מינו:

**השליח שעשה שליחותו בעל הבית מעל.** אע"ג דבכל התורה כולה אין שליח לדבר עבירה ילפינן לה במעילה חטא חטא מתרומה דמתחייב ע"י שליח:
