**כמאן אזלא שמעתתא דרב כר"מ.** דאית ליה בפ"ק דקידושין (דף כג:) דאין קנין לעבד בלא רבו וסבר רב דבאשה נמי קאמר ר"מ דאין קנין לאשה בלא בעלה:

**כיצד משתתפין במבוי.** חצירות הפתוחות למבוי אוסרות זו על זו לטלטל מתוכן למבוי משום דחצירות מיוחדות לבעליהן והמבוי לרבים וגזרו חכמים דילמא אתי לאפוקי מרשות היחיד לרשות הרבים עד שישתתפו יחד ונראה כאילו דרין כולם יחד במקום שמונח שיתופן:

**דכיון דלזכות לאחרים הוא מיד בעלה זכיא.** דכיון דבעל גופיה מזכה להם ומסתלק ממה שזוכה כדאמרינן במתנה שהבעל נותן לאשתו קנתה ואין הבעל אוכל פירות:

**מתניתין בשיש לה חצר באותו מבוי.** ואוסרת על בני המבוי וצריך הבעל לזכות גם לאשה אבל מתני' דעירובין מיירי בשאין לה חצר הילכך אין לה יד לזכות לאחרים:
