וה־ usucapio היתה מיוחדת רק לרומאים (quirites). ותחת זו חקקו בשביל קרקעות הפרובינציא את ה־longi temporis praescriptio, לפיה צריך המחזיק להחזיק בקרקע בלי מפריע **י' שנים** בפניו inter praesentes, כלומר אם בעל השדה גר באותה המדינה, **וכ' שנה** שלא בפניו, inter absentes, כלומר אם בעל השדה גר במדינה אחרת.

כי בראשונה היה משפט ה"חזקה", "חזקת־קנין" "ישיבה" ממש, שהרי אמרו בקידושין כו א: ובחזקה מנלן אמר חזקיה אמר קרא ושבו בעריכם אשר תפשתם (ירמ' מ י) במה תפשתם **בישיבה**. **דבי ר' ישמעאל** תנא וירשתם אותה וישבתם בה (דב' יא לא) במה ירשתם **בישיבה**. וזו שנויה **במכילתא דברים** (מדרש תנאים 61), שהיא מדרש ר' ישמעאל (כמו שהעיר הופמן בתחילתה): וירשת אותם במה **וישבת בארצם – בחזקה**, נמצינו למדים שהקרקעות נקנין [בחזקה והמטלטלין] במשיכה (= מ"ת 112).

מכאן נראה **שמתחילה** לא היתה ה"חזקה" צריכה כלל ל"טענה", רק ל"תפישה" ו"ישיבה" או "ירישה וישיבה", מעין זו של הרומאים הקדמונים, אבל מפני תיקון־העולם עִמדו אח"כ ותקנו לחזקה זו – טענה, כמו שתקנו אותה אח"כ גם הרומאים, והקילו בחזקת־קנין, שאין צורך בו ב"ישיבה", אלא ב"נעל וגדר ופרץ כל שהוא" דיו.

ועיקר ה"חזקה" היא לדעת ר' יהודה **שנה אחת** בפניו, וג' שנים שלא בפניו, שהרי שנינו (מ"ב): אמר ר' יהודה לא אמרו ג' שנים אלא כדי שיהא באספמיא **ויחזיק שנה** וילכו ויודיעוהו שנה ויבוא לשנה אחרת, ופשט המשנה הוא שהחזקה היא לר' יהודה שנה, וכן מפורש בתוס' פ"ב א: אבל אם היה עמו במדינה כיון שאכלה **שנה אחת** הרי זו חזקה² והרי לנו כאן מעין הד קול י"ב הלוחות.

רש"י פי' בצדק "הולכי אושא" על אלה הגולים, ההולכים מיבנה לאושא, כי ר' יוחנן רמז בוודאי למעשה ידוע וגם להולכים רבים, ותחילת "הליכה" זו היא האספה הגדולה שהיתה באושא "בשלפי השמד", שנתכנסו שם **תלמידי ר"ע: ר"מ ור' יהודה** – בן העיר – **ור' יוסי ור' שמעון ור' אלעזר בן יעקב וכו'** ושלחו אצל זקני הגליל ואמרו כל מי שהוא למד יבוא וילַמֵד וכל מי שאינו למד יבוא וילמוד וכו', אבל **ר' ישמעאל לא** נזכר שם²⁸. ואי־אפשר כלל שיזכר שם, שהוא כבר מת בשמד בחיי **ר"ע**²⁹ ועל מותו ניבא שמואל הקטן בן זמנו של **רבן גמליאל דיבנה**³⁰, אבל באושא היה **רשב"ג**, בנו של הנזכר³¹.
