"**רבי ריש מתיבתא** הוא ושכיחי **רבנן** קמיה ומחדדי שמעתתיה" (נדה יד ב); אבל חביריו החולקים עמו, **ר' יוסי בר' יהודה, ר' אלעזר בר' שמעון**, שניהם היו **גדולים** ממנו¹⁰ **וזקנים** ממנו. ואע"פ שראב"ש ישב אתו יחד לפני אביו ולפני רשב"ג¹¹, ואע"פ שר' יוסי בר' יהודה התהלך את רבי¹² – לא מצינו אותם ב"בית הועד" (ר' יוסי בר' יהודה מת לפניו¹³, וכן ראב"ש¹⁴. ואף בחייו לא היו היחסים ביניהם טובים ביותר)¹⁵, וקרוב הדבר שלא באו כלל **לבית־שערים או לציפורי**.

**היחיד** שאנו מוצאים אותו בבית הועד (של רבי) הוא – **ר' ישמעאל בר' יוסי, בן ציפורי**. אותו אנו מוצאים בפירוש ב"בית הועד"¹⁶. ואנו מוצאים אותו כמה פעמים "לפני" רבי¹⁷, ור' שאל ממנו¹⁸. וכשחלה שלח אליו רבי אמור לנו ב' וג' דברים וכו'¹⁹. הוא מסר הרבה דברים בשם אביו ("כך אמר אבא", ריב"י "משום אביו" בברייתות): תוס' תרומות פ"ד ב (אבא היה וכו'), שם ו (משום אביו), מעשרות פ"א א (משום אביו), שם ג²⁰ (משום אביו, ירוש' פ"א מט ע"א, בבלי חולין כה ב, ואמרי לה זה וזה לחיוב – כנו' התוס' והירוש'); חלה פ"א א (משום אביו), ירוש' פ"א נח ע"א, בבלי פסח' לז ב: זה וזה לפטור **ואמרי לה זה וזה לחיוב** – כבבלי חולין –, והלשון האחרון עיקר, כמשנת עדיות פ"ה מ"ב, ולפי־זה, ר' ישמעאל בר' יוסי הוא הראשון שפירש את המחלוקות שבחלה פ"א מ"ו, **שנשנו כך בדורו של רבי**, שהן – משניות שני "תלמידים" (בבלי וירוש'), ושאביו היה מחייב גם "מעיסה" גם "חליטה"; שבת פד א (משום אביו, שלא כסתם פ"ה מ"א; בבלי נא ב: מחליפין לפני ר' וכו' אמר לפניו ר' ישמעאל בר' יוסי כך אמר וכו'), סוכה פ"א י (בבלי כ ע"א, משום אביו: בהתאם למשנת כלים פי"ז מי"ז), תענית פ"ד יא (משום אביו), יבמות פ"ט א (משום אביו; במשנה פ"ז מ"ג: ר' יוסי אומר, בבלי סז א–ב: כולה (ברייתא) ר' ישמעאל בר' יוסי); נדה פ"ד יב (משום אביו, בבלי כה א: שאלו לפני **רבי** וכו' אמר להם לא שמעתי אמר **לפניו** ר' ישמעאל בר' יוסי כך אמר אבא וכו' א"ל אילמלי דבר חדש אמרת לנו משום אביך שמענוך עכשיו וכו'); טהרות סוף פי"א (משום אביו). והנה ראינו שכמה דברים שנשנו בברייתות בשם "ר' ישמעאל בר' יוסי אומר משום אביו", נאמרו בבית־הועד **לפני רבי**, ואולי נשנית משנת יבמות שהזכרתי (ר' יוסי אומר) על פיו, ואפשר שעל פיו נסדרו במשנתנו שתי המחלוקות שבחלה פ"א מ"ו זו אצל זו.

מחלוקת **חדשה** אינה מכריעה אפוא במקום "שמועה" **ישנה**, ו"שמועה" **חדשה** אינה משפיעה על מחלוקת **ישנה**, אלא המשנה נשנית כמו שנשנית, **וההלכה** נוהגת לפי הכללים המקובלים (ב"ש וב"ה הלכה כב"ה, יחיד ורבים הלכה כרבים, ר"מ ור' יהודה הלכה כר' יהודה, ר' יהודה ור' יוסי הלכה כר' יוסי). אלא שיש רשות לב"ד להשתמש בדברי יחיד "בשעת הדחק", או כדברי המשנה בעדיות "אם יראה ב"ד את דברי היחיד **ויסמוך** עליו", כמו שפסקו כמה אמוראים ראשונים ואחרונים כדברי יחיד בכמה מקומות (עי' תוי"ט). אבל ה"משנה" – **נשנית כמו שנשנית** אפילו לאחר היתרו של **רבי**, כמו שאמרו⁶⁸: תמן תנינן⁶⁹ הרוחץ וכו'. שמואל אמר **מה יעביד הדין סבורא דלא יליף ולא שימש והדא מתניתא קודם עד שלא התירו** הבאת לונטית ר' ירמיה (ו)רבי זעירה רב יהודה בשם שמואל ר' התיר לונטיות. וכך אמרו⁷⁰: ר' קרוספי בשם ר' יוחנן רבן גמליאל ("ברבי") ובית דינו התירו באיסור שני פרקים⁷¹ וכו', **ויעקרו אותן מן המשנה** וכו' כדי להודיעך, אמר ר' מנא כיי דתנינן תמן⁷² שאם יאמר אדם כך אני מקובל יאמרו לו כדברי רבי איש פלוני שמָעת, וכן שאם יאמר אדם שמעתי שאסור לחרוש עד ראש השנה יאמרו לו באיסור שני פרקים הראשונים שמעת.

יוצא אפוא שראש־הישיבה היה שונה תחילה ל"אחיו"⁷⁷, אח"כ ל"בניו", ואח"כ ל"זקנים" (חכמי הישיבה) ואח"כ ל"כל העם" ("תלמידים"). ובוודאי שאע"פ שהתוכן היה אחד לא היתה המשנה ל"זקנים" ו"לכל העם" בסגנון אחד. ואמנם מוצאים אנו גם אצל **רבי**, ששנה משנה אחת **לבנו** ר"ש ושנאה לתלמידו **לוי בפנים אחרות**⁷⁸. ולא עוד אלא ששנה פעם אחת **לר' חייא** משנת **ר' יוסי** ולבר־קפרא משנת ר' **שמעון**⁷⁹. ומן "**שלשה עשר**" (גוזמא) "פנים" של "משניות" שהיה רבי שונה – שנה **לר' חייא** "שבעה"⁸⁰.
