התורה אמרה: כל מלאכה לא יעשה בהם אך אשר יאכל לכל נפש הוא לבדו יעשה לכם (שמי יב טז). ובנחמ' ח י (בר"ה): ושלחו מנות **לאין נכון לו**¹. אבל כבר באמצע ימי הבית השני נהגו לאסור גם באוכל־נפש, דברים שאינם "מוכנים" ו"מוזמנים" מערב יו"ט (יוני שובך, צפרים וחיות שקננו), והזמנה זו כבר היתה הלכה קבועה בימי **שמעיה ואבטליון**², ובאחד מסעיפי הלכה זו נחלקו **ב"ש וב"ה**³.

וכבר באותו זמן **ולפניו** נהגו לאסור גם ביו"ט דברים שהם "משום שבות", שהרי רכיבה היא משום שבות⁴, וסמיכה שהיא משום שבות⁵, וטעמה משום שהוא נשען על הבהמה⁶ – **תולָדת** רכיבה היא⁷, ובסמיכה זו כבר נחלקו **הזוגות הראשונים**, יוסי בן יועזר ויוסי בן יוחנן⁸.

ובפ"ג מ"ד: **ר' יהודה** אומר וכו', לברייתא שבבבלי (ברייתא **בבלית**) כו א, זו היא גם דעתו של **רבי** (ר' יהודה הנשיא), ושנה אותה רבי במחלוקת ר' יהודה ור"ש, שהרי כלל מקובל היה, שר' יהודה ור"ש הלכה כר' **יהודה**. ובפ"ה מ"ז: אלו הן בייתות וכו' – **תוספת** היא (ע" ד"ס), **ורבי** (בברייתא שבגמרא ובתוס') **חולק** על פירוש זה.
