מסכת קידושין שלנו אינה כלל מעור אחד. מורכבת היא באמת **משלש מסכות**: א) המסכת הראשונה היא **פרק ראשון**, פרק **קניינים** (של אשה, עבד, נכסים, חילופין) **וחיובים** (של אנשים ונשים, ארץ וחו"ל) עם סיום **אגדי** (מ"י), **הרגיל בסוף מסכות**.

כבר הסבוראים הרגישו בהבדל שבלשון בין פ"א לפ"ב. ואמנם כן לשון פ"א עתיקה וקצרה וקרובה ללשון ב"ק פ"א מ"א – מ"ד, לשון של כללים קצרים בגוף ראשון, והסיום "כל העושה מצוה אחת מטיבין לו ומאריכין לו ימיו ונוחל את הארץ (= ארץ ישראל, מ"י)" עתיק הוא וקרוב ללשון הכתוב בדברים, וסגנונו כסגנון ישעיה.

ובימים ההם "נקנית" האשה כמו שנקנה עבד. במ"ה "נכסים שיש להם אחריות וכו' " כבר השתמש ר' אליעזר, וסיפא "נכסים שאין להם אחריות נקנין וכו' " הוא ה"מעשה במדוני אחד שהיה בירושלים", שהביא ר' אליעזר. ובפירוש "כל מצות הבן על האב" (מ"ז) עוסקים בתוספתא רבן גמליאל ועוד תנאים. בפירוש "משנה" שבמ"י נחלקו ר' מאיר ור' יהודה. ונוספו בה במ"ג ע"י תנאים מאוחרים, או רבי, מחלוקת ר"מ וחכמים. "המשנה הראשונה" היתה בודאי משנה קצרה "וקונה את עצמו **בכסף ובשטר**" ולא יותר. ומכמה משניות יוצא שהעבד יכול לכתוב שטר¹.

ב) עיקר **קידושין** הוא **פרק ב' מ"א–פ"ג מי"א** (ופ"ד מ"ט), אבל **פ"ג מי"ב–פ"ד מי"ד** היא מסכת **עריות ויוּחָסין**, ואין לה ענין ל"קידושין". אלא שע"י ההתחלה: כל מקום שיש **קידושין** ואין עבירה וכו', נתחברה לקידושין, והיא שייכת במקצת **ליבמות פ"ד מי"ג**, ושם **פ"ו**. ופ"ד מ"ט, שהוא ענין קידושין, אין לו הקבלה בתוס' שם (עי' להלן), ושייך **לפ"ג** מ"א, שהיא מסודרת בתוס' **אחרי** פ"ב מ"ד, ושנויה בתוס' **יבמות** פ"ד.

מסכת "עריות" זו משנה עתיקה היא **בעיקרה** (חוץ מהוספות אחדות: פ"ג מי"ג: ר"ט – ר"א, פ"ד מ"ג ומ"ה **סיפא**: ר' יוסי אומר וכו', ומ"ו **סיפא** – מ"ז: ר' יהודה – ראב"י – ר' יוסי, ומי"ד **רישא**: ר' יהודה –וחכמים). אמנם **לא** משנת **הלל**, כמו שטעו כל החוקרים למן רנ"ק והלאה)² לדון מדברי שמואל (קידושין עה א): **הלל** שונה עשרה יוחסין וכו'; כי הלל **זה** הוא אחד משוני **ברייתות**, נכדו של **רבי** ובן דורו של שמואל. "תני הילל" שבגטין לז א ונזיר מד ב³, אבל בוודאי משנה **מזמן הבית**, והיא שגרמה כנראה להשפעה **הארמית** (כהני לויי וכו', ברבים **ארמי**), מעין "**חב** המזיק" שבב"ק שהזכרתי.
