The Torah commands us to take vows and oaths with utmost seriousness. The Israelites were nearing the land where they were summoned to construct a society unlike any other. It was to be a free society based on a covenant between the people and God. The rule of law was to be secured not by the use of force but by people honouring their moral commitments, their voluntary undertaking to God that what He commanded, they would do.

A covenantal society is one in which words are holy, sacrosanct. This is the principle at the heart of Judaism as a code of collective freedom, a constitution of liberty. But we can also use language in a quite different way – not to describe what is, but to commit ourselves to some form of behaviour in the future. So for instance when a groom says to his bride under the *ḥuppa*, “Behold you are betrothed to me…” he is not describing a marriage. He is getting married. It is this use of language, not to describe something already in existence but to create something that didn’t exist before, that links us to God. God used words to bring the natural universe into being: “And God said…and there was.” *We* use words to bring a social universe into being. What the Torah is telling us is that words create because words are holy; that is to say, they bind. When words bind, they generate trust. Trust is to society what predictability is to nature: the basis of order as opposed to chaos.

ועדיין, יש הבדל יסודי בין נדר לבין שבועה. נדר משפיע על מצבו של דבר — ״חפצא״, חפץ, בלשון הלכתית. הנדר מקדש את הדבר כך שלא יהיה נגיש לי לשימוש אישי. אני עשוי לנדור שלא לאכול מאכל מסוים. כלומר דבר־מה הוא לי, מעכשיו, מאכל אסור. שבועה, לעומת זאת, משפיעה על האדם הנשבע, על ה״גברא״, ולא על הדבר. אם נשבעתי שלא לאכול איזה מאכל, הדבר האסור אינו המאכל אלא שאני אוכל אותו. הנדר והשבועה שניהם מחייבים, אך בדרכים שונות.

However, there is a fundamental difference between a vow and an oath. A vow, *neder*, affects the status of an object (*ḥeftza*). It dedicates it in such a way as to render it inaccessible to me for my personal use. I may vow not to eat something. That something is now, for me, forbidden food. However, an oath, *shevua*, affects the person (*gavra*) not the object. What is now forbidden is not the food but my act of eating it. Both acts bind but in different ways.

This distinction led Rav Soloveitchik into a fascinating philosophical reflection on the existential difference between oaths and vows.³ (Jerusalem: Urim, 2011), 369–75. The difference between *gavra* and *ḥeftza*, he suggests, is the difference between subject and object. “When I say that I am writing a letter, I am the *gavra*, the subject of the action, while the letter is the *ḥeftza*.” A *gavra* acts, a *ḥeftza* is acted on. A *gavra* influences, a *ḥeftza* is influenced. A *gavra* is active, a *ḥeftza* passive. A doctor cures, a patient is cured. A judge passes sentence, a prisoner is sentenced. These are two different modes of being. Sometimes we are one, sometimes the other.

By way of illustration, Soloveitchik cites the example of Moses at Mount Sinai and the difference between the first and second set of tablets. There is a commentary in the *Yalkut Shimoni* ⁴ 393. that suggests that Moses did not break the first set of tablets deliberately. Rather, as he descended the mountain at God’s command and saw the people dancing around the golden calf, the letters flew off the tablets which then became so heavy that he could no longer bear their weight. They fell from his hands and broke.

The answer the Rav gave was that on the first occasion Moses was a *ḥeftza*. He did not choose to descend the mountain. He was ordered to do so, against his inclination, by God. On the second he was a *gavra*. It was his passionate pleading that had caused the people to be forgiven and he was eager to obtain the second tablets as a sign that the covenant was still in force. When we act out of our own inclination and desire, we have energy, and strength that we lack if forced into a situation not of our choosing.

Perhaps the most vivid example of *ḥeftza* and *gavra* in biblical narrative is the case of Joseph. In every scene in his early life we see him as the *ḥeftza* . He rarely acts; he is almost always acted on. His father loves him more than his other sons. He gives him a richly embroidered cloak. His brothers hate him, think of killing him, and eventually sell him as a slave. Potiphar’s wife attempts to seduce him and when she fails, accuses him of rape. The other significant episodes either happen to him – the dreams – or are explicitly attributed to God: his success in running Potiphar’s household, and later, the prison and his ability to interpret the dreams of others. Throughout this time Joseph is the object, not the subject, of verbs. His life is determined by what other people do to him.

From that moment onward he is the most active character in the Torah, organising the Egyptian economy, using the famine to restructure Egyptian society, putting his brothers to a test to see whether they have reformed, sending for his father and the rest of the family, and settling them in the land of Goshen. The *ḥeftza* has become a *gavra*, the object has become a subject, Joseph-the-passive has become Joseph-the-active, even hyperactive.

Rav Soloveitchik quotes the statement in the Gemara that an oath is administered to each of us before we are born, saying, “Be righteous and not wicked.”⁵ The fact that this is an oath not a vow is essential. It means: Be a *gavra* not a *ḥeftza*, be a free and responsible choosing subject, not the passive object of other people’s acts. “If a human being is to act as an emissary of God, then they must be a *gavra*, constantly moving upward.”⁶ 374.

The difference between a vow and an oath thus becomes a metaphor for two different kinds of life, one defined by others and one self-created. That is the distinction Rav Soloveitchik drew with great force in his essay, *Halakhic Man*. One kind of person, he says, is “receptive, passive…wholly under the influence of other people and their views.” The other is “not passive but active. His personality is not characterised by receptivity but by spontaneity. He does not simply abandon himself to the rule of the species but blazes his own individual trail.”⁷ (Philadelphia: Jewish Publication Society of America, 1983), 127–28.
