**ומ"ש והוא שינתן עליהן ברצון הבעלים.** הרשב"א כתב בפרק השוחט עלה ל"א גבי פירות שנשרו לתוך אמת המים וכו' מכאן דקדקו התוספות דלא בעינן רצון הבעלים מדקאמר מי שידיו טמאות משמע אפילו אחר שאינו בעל הפירות ועוד דעיקרו מדכתיב וכי יותן מים וכו' והרמב"ם כתב והוא שינתן עליהם ברצון הבעלים עכ"ל. וליישב לדעת רבינו י"ל דמשמע ליה דפשיטא דרצון בעלים בעינן דאין סברא דרצון אחרים יגרום טומאה לדבר שאינו שלהם והנך דמייתי הרשב"א לא מכרע.

**ומ"ש ונתלשו המשקין.** זה נלמד מדתנן בפרק רביעי דמכשירין שצנון שבמערה נדה מדיחתו והוא טהור העלתהו כל שהוא מן המים טמא פי' דאז הוכשרו וכתבו התוספות בפ"ב דחולין עלה ל"א ע"ב והא דאמרינן בפ"ק דפסחים דאיכא תרי קראי לענין הכשר חד בתלושין וחד במחוברים וצריכי היינו כשנפלו במחוברים דמתכשרי לאחר שהעלם וכבר כתב רש"י בפירקא קמא דחולין עלה י"ו דאי אחשבינהו לגשמים בירידתם לצורך שום דבר וכו':

**משקין שנתלשו וכו'.** כתב הראב"ד ואילו היה בקרקע. ומ"ש ודבר זה מפורש במסכת מכשירין. הוא מה שכתבתי בסמוך צנון שבמערה נדה מדיחתו וכו' ומכ"מ מ"ש ואילו היה בקרקע ונתלו וכו' וגם אלו כמו כן מוכשרים אין הנדון דומה לראיה דה"ק כיון שנתלשו שלא לרצון הרי הם כאילו הם עדיין בקרקע ולא נתלשו וזה מבואר בדברי רבינו:

**וכתב** עוד הראב"ד ואם ניער וכו' כמדומה אני שנשתבש וכו'. בשתי השגות אלו טעמו שהוא ז"ל מפרש שהניעור השנוי במשנה היינו מה ששנו בברייתא לאחר שיצאו מכלי ובזה הוא שאמרו שינתקם בכל כחו כדי שלא יטמא בשעת פרישתו ומה שאמרו בברייתא המים נתלשין מצד עליון תחתון הוא כשהם עדיין בבגד עצמו ולא יצדק לומר בהם והוא שינתקם מעליו בכל כחו וי"ל שכך פירוש דברי רבינו אע"פ שירדו מצד העליון לתחתון טהורים בין בעודם בבגד בין לאחר שיצאו מהבגד והא דטהורים לאחר שיצאו מהבגד הוא שינתקם מעליו בכל כחו שאל"כ בשעת פרישתן נתטמאו ולענין הכשר בזמן שהם טהורים כלומר שהם על אדם טהור אינם מכשירים בין כשהם בבגד בין לאחר שיצאו מן הבגד מפני שאינם לרצון ואם ניער הרי זה בכי יותן משום דהוה ליה לרצון ובהשגה הראשונה כתוב לפי שהם ניטלין והוא ט"ס וצריך לכתוב במקומו לפי שהם בטלים. ובהשגה השנית כתוב שנשתבש כל המשנה וחסר בי"ת וכך צריך לכתוב בכל המשנה:
