**אם אין לו שה לפדותו וכו'.** בפ"ק דבכורות (דף ט':) אמרינן דלרבי יהודה דסתם לן תנא כוותיה הקפידה תורה על פטר חמור לפדותו בשה ואקשינן ומי הקפידה והא רב נחמיה בריה דרב יוסף פריק ליה בשילקא בשוויו בשוויו לא קאמרי כי קאמרי שלא בשוויו ומסיק (דף י"א) דטעמא דרבי יהודה משום דלא יהא חמור מן ההקדש ולא אמרה תורה בשה להחמיר עליו אלא להקל עליו תניא (דף י':) תפדה [אפילו] כל שהוא ופסק רב יוסף הלכתא הכי וכמה אמר רב יוסף אפילו פטרוזא בת דנקא אמר רבא אף אנן נמי תנינא וכו'. ופירש"י בשילקא עשבים שלוקות. חמור מן ההקדש שפודהו בכסף בשוויו. להחמיר עליו שלא יפדהו אלא בשה. אלא להקל עליו שאם פודהו בשה יכול לפדותו בפטרוזא. פטרוזא שה כחוש. ואמרינן בגמרא רבי יהודה נשיאה הוה ליה פטר חמור שדריה לקמיה דרבי טרפון אמר ליה כמה בעינא למיתב לכהן אמר ליה הרי אמרו עין יפה בסלע עין רעה בשקל בינונית ברגיא אמר רבא הלכתא ברגיא וכמה [ברגיא] תלתא זוזי וכו' קשיא הלכתא אהלכתא ל"ק כאן בבא לימלך כאן בעושה מעצמו ופירש"י קשיא הלכתא אהלכתא הכא אמרת הלכתא ברגיא ולעיל אמרת הלכה [כדברי חכמים] דאפילו בת דנקא. ויש לתמוה על רבינו למה לא חילק בין בא לימלך לעושה מעצמו כדמפליג גמרא וכ"כ עליו הראב"ד ז"ל א"א והשה עצמו צריך שישוה ג' זוזים וכו'. ועוד יש לדקדק בדברי רבינו שכתב לחלק בין אם היו דמי פטר חמור ג' זוזין או יותר לכשהם פחות מניין לו לחלק כן ושמא גירסא אחרת היתה לו בגמרא וצ"ע:

**(יט-כ) חמורו שלא בכרה וכו'.** משנה פרק קמא דבכורות (דף ט') חמורו שלא בכרה וילדה שני זכרים נותן טלה אחד לכהן זכר ונקבה מפריש טלה אחד לעצמו שתי חמוריו שלא בכרו וילדו שני זכרים נותן שני טלאים לכהן זכר ונקבה או שני זכרים ונקבה נותן טלה אחד לכהן שתי נקבות וזכר או שני זכרים ושתי נקבות אין [כאן] לכהן כלום אחת בכרה ואחת שלא בכרה וילדו שני זכרים נותן טלה אחד לכהן זכר ונקבה מפריש טלה אחד לעצמו. ובגמרא (דף ט':) מפריש טלה לעצמו וכיון דלעצמו הוא למה ליה לאפרושי לאפקועי לאיסוריה מיניה:

****כתב הראב"ד ילדו שתי נקבות וכו' עד ואינו צריך להפריש טלה לעצמו. א"א יש כאן שבושים והספיקות שמא הזכר יצא אחרי הנקבה עכ"ל. נראה שטעמו מפני שהוא סובר כדברי רש"י והתוספות שסוברים דכל היכא דקתני בענין פטר חמור אין כאן לכהן כלום מפריש טלה לאפקועי איסוריה והוא לעצמו ורבינו כתב דבשתי נקבות וזכר או שני זכרים ושתי נקבות אינו צריך להפריש טלה לעצמו וזה אצל הראב"ד שיבוש משום דכיון דלא מפסיד מידי למה לא יתקן בהפרשת טלה וכתב שיש כאן שיבושים משום דמשמע מדברי רבינו דבזכר ונקבה או שני זכרים ונקבה מפריש טלה לעצמו אע"פ שלא הוזכרה במשנה וגם הוא זכרונו לברכה לא הזכירו שהרי לא מיעט אלא שתי נקבות וזכר או שני זכרים ושתי נקבות וזה בעיני הראב"ד שיבוש לחלק במה ששנו אין כאן לכהן כלום בין זה לזה שבזה מפריש טלה לעצמו ובזה אינו צריך להפריש ולדעת רבינו י"ל דשאני ב' זכרים ונקבה דמתוך שהוא צריך לעשות בהם מעשה ליתן טלה אחד לכהן אמרינן ליה דיפריש טלה אע"ג דתרי ספיקי הוא אבל בב' נקבות וזכר או ב' זכרים וב' נקבות כיון דאינו צריך לעשות מעשה ליתן שום טלה לכהן לא אמרינן שיפריש טלה לעצמו מאחר דתרי ספיקי הוא. ומ"ש והספיקות שמא הזכר יצא אחר הנקבה טעמו להשיג על רבינו למה כתב שיש כאן ספיקות הרבה שהכל נכלל בספק אחד שהוא שמא הזכר יצא אחר הנקבה:
