הראב"ד שגזר אומר שרבינו פסק כר"ל והיאך אפשר להעלות כן על הדעת שהרי ר"ל מפליג בגג בין של בית לשל מערה ובחורבה בין עבודה לשאינה עבודה ובעציץ בין נקוב לשאינו נקוב ובספינה בין של עץ לשל חרס ורבינו לא מפליג כלל. וי"ל דהראב"ד לטעמיה דסבר לר"י אינו מביא מן הגג ומהחורבה כלל דלפי זה מי שיאמר שיביא אינו אלא כר"ל וק"ל למה לא פסק כר"י ותו דאפילו כר"ל לא אתיא דאיהו מפליג בין גג לגג ובין חורבה לחורבה ורבינו דמביא ואינו קורא הא באחד בלבד אינו מביא וקצת סמך יש לזה מדקאמר בפרק הספינה מ"ט דר"מ באילן אחד ומ"ט דרבנן בשני אילנות ולא קאמר ומ"ט דרבנן בין באילן א' בין בשני אילנות אע"פ שאין טעם לחלק בין אילן אחד לשני אילנות כיון שאין לו קרקע בין בזה ובין בזה אפשר שגם זה בכלל מה ששאל מ"ט דרבנן בשני אילנות. אח"כ מצאתי בירושלמי דביכורים פ"ק (הלכה ו') אחד אינו מביא כל עיקר שנים מביא ואינו קורא וזה מבואר כדברי [רבינו]. ומ"מ רבינו שנתן טעם לאילן אחד מפני שאין לו קרקע יקשה מ"ש שני אילנות וי"ל דה"ק מפני שאין לו קרקע בודאי מה שאין כן בשני אילנות דמספקא לן כדאמר בפ' הספינה וכתבו רבינו בפ"ד. וא"ת למה השמיט רבינו דין קונה שני אילנות שמביא ואינו קורא וי"ל דמדיוקא דרישא וסיפא איכא למשמע מינה דמדקתני באילן אחד אינו מביא משמע הא שנים מביא ומדקתני בשלשה הרי הוא כמי שקנה קרקע כלומר וקורא משמע הא שנים אינו קורא ולקמן
