**ומ"ש ואם נטמאו הביכורים אין הסלים לכהנים.** יש לתמוה דבירושלמי פ"ק דביכורים (הלכה ה') אמרינן איפכא ויליף לה מדכתיב ולקח הכהן הטנא מידך כלומר שאינו לוקח הטנא וכך היא גירסת ר"ש והרא"ש אבל רבינו גורס אין הסלים לכהנים ולפי זה יליף מדכתיב הטנא משמע הטנא הנזכר עם הביכורים כשהם ראויים:

**והראב"ד** כתב אומר אני מה שבידם וכו' כלומר שהוא מפרש דמה שבידם היינו הביכורים עצמם ופשטא דלישנא משמע כדברי רבינו. וכתב רבינו וכן היו תולים מצד הסלים כר' יוסי דאמר הכי בתוספ' וסבר רבינו דלאו לאיפלוגי אתא אלא לפרושי דע"ג הסלים דתנן לא על גביהם ממש היו כדי שלא יטנפו את הפירות:

**ומה שכתב ואין הקרבן מעכב** טעמו מדאמרינן שם בירושלמי גבי טעונים לינה דכתיב ופנית בבקר הא כל הפונות שאתה פונה לא יהיו אלא בבקר אמר רבי יונה הדא דתימא כשאין עמהם קרבן אבל יש עמהם קרבן בלא כך טעון לינה מחמת הקרבן נראה בהדיא שאין הקרבן מעכב. ומה שכתב רבינו לקמן בסמוך הביא בכוריו למקדש וקרא והקריב שלמים לא יצא באותו היום לאו למימרא דתרתי בעינן אלא רבינו סידרא דמילתא לכתחלה נקט ואם לא הביא קרבן טעון לינה משום ביכורים כמו שנתבאר:
