**ומ״ש רבינו אע״פ שהפרישם קודם החג וכו'** יש לתמוה דהא בפרק אלו הן הלוקין אמר רבי אלעזר אמר רבי הושעיא הפריש ביכורים קודם לחג ועבר עליהם החג ירקבו ויהיב טעמא בגמרא משום דכל שאינו ראוי לבילה בילה מעכבת בו וצ״ל שדחאה רבינו לזו מהלכה מקמי ההיא דפרק השולח (גיטין דף מ״ז:) דאמר ר״י בר חנינא בצרן ושגרן ביד שליח ומת שליח בדרך מביא ואינו קורא שנאמר ולקחת והבאת עד שתהיה לקיחה והבאה כאחד ואע״ג דבירושלמי מוקי לה בשליקטן לשלחן ע״י שליח אבל ליקטן להביאן הוא לא ישלחם ביד אחר שכל הביכורים שנראו להתיר בקריאה אינם נתרים אלא בקריאה מאחר דגמרא דידן מייתי להא דר״י בר חנינא בפרק הספינה (בבא בתרא דף פ״א) ובפרק השולח סתמא ואי הוה סבר גמרא דידן כירושלמי לא הוה שתיק מלפלוגי בהכי וכגמרא דידן נקטינן ועוד דמתניתין דהפריש ביכוריו ואח״כ מכר שדהו ומתניתין דיבש המעיין ונקצץ האילן דמיתנו סתמא אתו כר״י בר חנינא ואע״ג דבירושלמי משני להו שינויא דחיקא ולא סמכינן עליה ולפי זה מ״ש רבינו לעיל בפרק זה גבי הקונה שני אילנות שכל שאינו ראוי לקריאה מפני הספק הקריאה מעכבת בו התם שאני דמחמת ספק הוא:
