**ומ"ש רבינו והל"מ שיהו מפרישין בארץ עמון ומואב מעשר עני בשביעית.** שם במשנה א"ר אליעזר כן ומ"מ משמע דלאו דוקא הלכה למשה מסיני ממש קאמר דהא קתני התם דעמון ומואב הוא מעשר זקנים וכן בדין דהא חוצה לארץ מן התורה אין נוהגים בה לא תרומה ולא מעשרות וכן כתב רבינו עצמו בתחלת הלכות תרומות וכתב עוד שם שחכמים הראשונים התקינו שיהיו נוהגות אף בארץ מצרים וכן פירש ר"ש הלכה למשה מסיני לאו דוקא אלא כהל"מ ולכן יש לתמוה על רבינו שסתם וכתב שדבר זה הלכה למשה מסיני וצריך לומר שהעתיק לשון המשנה והרואה דבריו בתחלת הלכות תרומות ידע דלאו דוקא:
