**מ"ע לעשות אדם מעקה לגגו וכו'. ומ"ש והוא שיהיה בית דירה אבל בית האוצרות וכו'.** יש לתמוה על זה דהא תניא בסיפרי אין לי אלא בית מנין הבונה בית התבן ובית הבקר ובית העצים ובית האוצרות ת"ל לא תשים דמים בביתך יכול אף בונה בית שער אכסדרא ומרפסת ת"ל בית בית מיוחד שהוא בית דירה יצאו אלו שאינם בית דירה וכן כתבה ספר מצות גדול הרי דבית הבקר ובית האוצרות חייב והיאך פטר רבינו. ואפשר שטעמו משום דבפ"ק דיומא (דף י"א) לענין מזוזה אמרינן דהני תנאי היא ותנא בסיפרי סבר כמאן דמחייב ורבינו בהל' מזוזה פוסק כמאן דפטר:

**בית של שני שותפין וכו'.** שם בפ' ראשית הגז (חולין דף קל״ו) אהא דתניא בהמת השותפין חייבת בראשית הגז ור' אלעאי פוטר אמר רבא מודה ר' אלעאי בתרומה וכו' מעקה אע״ג דכתב רחמנא לגגך דידן אין דשותפות לא כתב רחמנא כי יפול הנופל ממנו אלא גגך למאי אתא למעוטי בתי כנסיות ובתי מדרשות ופירש״י כי יפול הנופל כל שראוי ליפול הימנו ואפילו של שותפות. בתי כנסיות שאין חלק לאחד מהם בו שאף לבני עבר הים הוא ועוד שאינו בית דירה. ודע דאמרינן בגמ' בתר הכי א״ר ביבי בר אביי ליתנהו להני כללי דתניא בהמת השותפין חייבת בבכורה ור' אלעאי פוטר א״ר חנינא מסורא ליתנהו להני כללי דתניא בהמת השותפין חייבת במתנות ורבי אלעאי פוטר ופי' רש״י ליתנהו להני כללי דאמר רבא דמודה רבי אלעאי בכל הני דהא תניא דפליג ר' אלעאי בבכורה ולא מרבי לה מבקרכם וצאנכם עכ״ל. משמע שהוא מפרש דאכולהו מילי דלעיל קאי ומעקה מכללן וכ״כ סמ״ג שר' אלעאי פוטר בית דשותפין ממעקה וכתב ויכול להיות שאין הלכה כר' אלעאי אע״פ שהלכה כמותו בראשית הגז לענין פיטור חו״ל וכתב שזה טעמו של רבינו ואני אומר עוד שאפשר שרבינו מפרש דלא קאי ליתנהו להני כללי אלא לקצת דברים שאמר רבא ואין מעקה מכללן אלא אף ר' אלעאי מודה בו כדאמר רבא:

**גובה המעקה אין פחות מעשרה טפחים וכו'.** בסיפרי כמה הוא מקום מעגלו שלשה טפחים בית דורסו עשרה ופירש ספר מצות גדול מעגלו גובהו בבור ג' טפחים ובבית גובהו עשרה. והראב"ד כתב על דברי רבינו גובה המעקה אין פחות מעשרה טפחים א"א דוקא ממקום דורסו והוא המקום הנמוך שבו אבל שאר צדדים ג' טפחים עכ"ל. נראה שהיה מפרש כן הברייתא הנזכרת ונראה לי שהטעם הוא שמאחר שמצד אחד הוא גבוה י' טפחים ע"י כך הוא נזהר משאר צדדין שאין גבהם אלא ג' טפחים:
