**כלי ברזל לא נתנה בו תורה שיעור וכו'.** בפרק הנשרפין (סנהדרין דף ע״ו) אמר שמואל מפני מה לא נאמר יד בברזל שהברזל ממית בכל שהוא וכו' וה״מ דברזיה מיברז ופירוש רש״י לא נאמרה יד בברזל כמו שנאמרה באבן יד בכלי עץ יד משמע שיש בה מלא אחיזה דבעינן שיעורא אבל ברזל כתיב ואם בכלי ברזל הכהו. דברזיה מיברז פנוש״ט בלעז אבל הכהו לאורכו דרך הכאה שיעורא בעינן:

**המכה את חבירו בלא כלי והמיתו וכו'.** הכי משמע בפרק הנשרפין (סנהדרין דף ע״ח:) במתניתא דנתכוין להכותו על מתניו ולא היה בה כדי להמית על מתניו וכו' נתכוון להכות את הגדול ולא היה כדי להמית את הגדול:

**ומה שכתב או שבנה עליו מקום וכו'.** נראה שפירש רבינו שזה בכלל מה שאמרו שם או באיבה לרבות המצמצם או שהוא נלמד מדין הכניסו לבית שיש דאיתיה התם וכתבו רבינו בסמוך אף על גב דהתם בעינן שהדליק עליו את הנר התם שאני שהיה פתח לביתא דשיישא אבל אם בנה לפני הפתח של ביתא דשיישא אע"ג דלא אדליק ביה שרגא חייב.

**ומה שכתב או שכפה עליו גיגית או שפרע עליו את המעזיבה.** שם אתמר כפה עליו גיגית [וכו' ופירש רש"י] ומת בהבלא או שפרע עליו את המעזיבה והוא ישן ונכנסה שם הצנה פטור שההורג בא לאחר זמן [ע"כ]. ופסק להקל בדיני נפשות ומ"מ יש לתמוה מה בין כפה זה למה שכתב לעיל בסמוך שאם בנה עליו מקום עד שמנע ממנו הרוח שהוא חייב ושמא י"ל שהבונה עליו מקום מכל צדדיו קודם שיסתום הכותל האחרון כבר נתמעט הרוח וכשסתם הכותל הרביעי אז כלה הרוח ונתרבה ההבל שהמיתו ולפיכך חייב משא"כ בשכפה עליו גיגית וצ"ע.

**ומה שכתב או שהשיך עליו את הנחש.** שם במשנה שיסה בו את הכלב שיסה בו את הנחש פטור השיך בו את הנחש ר' יהודה מחייב וחכמים פוטרין ובגמ' (דף ע"ח) לדברי חכמים ארס נחש מעצמו הוא מקיא לפיכך נחש בסקילה והמכיש פטור ופירש רש"י מעצמו מקיא בנשיפתו וכשהשיכו זה עדיין לא היה בו כדי להמית לפיכך גרמא בעלמא הוא אע"פ שיודע שסופו להקיא מיהו לאו מכחו מיית:
