**וכתב הראב״ד שהחנות רשות היחיד א״א הפירוש הזה חשך ולא אור ומה בין זה לזה אבל רישא וכו'. איני יודע למה חרד כל החרדה הזאת לומר שהפי' הזה חשך ולא אור ועוד מה זה שכתב ומה בין זה לזה והלא כבר ביאר רבינו מה בין זה לזה כשהוא חנות אחת טמא הרי כלל החנות דבר טמא שהוא מונח בר״ה ספק נכנס ונטמא ספק לא נכנס טהור כדין ספק טומאה ברשות הרבים אבל כשהם שתי חנויות אחת טמאה ואחת טהורה ונכנס ודאי לאחת מהם ואינו יודע לאיזו מהם הו״ל נכנס לרשות היחיד ואינו יודע אם נטמא דהוי ספק טומאה ברשות היחיד וטמא וכן מבואר בדברי רבינו בפירוש המשנה והוא פירושו של הראב״ד: וכן בקעה בימות הגשמים וכו'.** בפרק ששי דטהרות וכחכמים ואיתא בפרק קמא דפסחים (דף י') ופרק חזקת (בבא בתרא דף נ״ה) ופרק בתרא דעבודה זרה (דף ע'):

**וכתב** הראב"ד או בנייר ונתון לתוכה ספק נגע א"א לא ידעתי מהו זה וכו'. ואני אומר שגירסת רבינו בתוספתא לא היתה כגירסת הראב"ד והטעם מבואר שמאחר שהככר שהוא המקבל טומאה נתון לתוכה הרי הוא כרשות היחיד ועוד שכיון שהיא על כתיפו הוי כמונח ברה"י כמו ששנינו בפרק רביעי דטהרות שני רוקים וכו' וכיון שהוא מונח על כתיפו הוי יש בו דעת לישאל וספיקו בכל ענין טמא ואי זה סופר טועה הגיה מדעתו בבא זו לחלק בין הכניס ידו לתוכה ללא הכניס מפני שבבבא ראשונה חילקו בכך ולא שת לבו לזאת דלא שייך לחלק בה בכך כמ"ש ותמהני על אדוננו הראב"ד ז"ל שלא דקדק בכך ואפשר שמפני שהרגיש בכך לא כתב כלשון משיג אלא כמסתפק:
