**במה דברים אמורים בשעת משא ומתן וכו'.** מימרא דרב שם (דף ל"ד) ופירש רש"י דבשעת משא ומתן בעינן שיעמוד בדבריו לחזר אחר ראיות שמא ימצא חיזוק לזכות דשמא לא טעה אבל בשעת גמר דין שחיפש כבר הכל ועכשיו נראה שטעה חוזר ומלמד חובה:

**תלמיד שהיה מזכה ומת רואין וכו'.** סנהדרין פרק נגמר הדין (סנהדרין דף מ״ג) בעא מיניה רב אחא בר הונא מרב ששת אמר אחד מן התלמידים יש לי ללמד עליו זכות ונשתתק מהו ופירש״י מי אמרינן אי לא נשתתק הוה מיחוש בדבריו וצריך לסתור הדין ולהביא דיינים אחרים מנפח רב ששת בידיה נשתתק אחד אפילו אחד בסוף העולם נמי פירש״י מנפח כלומר רוח הוא זה שכיון שנשתתק מה הועיל אי להכי אתית למיחש בכל היוצאים ליהרג נמי אימא שמא יש אחד בסוף העולם. התם לא קאמר הכא קאמר מאי ת״ש דאמר ר' יוסי בר חנינא אחד מן התלמידים שזיכה כלומר הוציא דבריו וטעמו לאור ומת רואין אותו כאילו הוא חי ועומד במקומו זיכה אין לא זיכה לא:

**שנים שאמרו טעם אחד וכו'.** סנהדרין פרק אחד דיני ממונות (סנהדרין דף ל״ד) בעא מיניה ר' אסי מר' יוחנן אמרו שנים טעם אחד משני מקראות מהו אמר ליה אין מונין להם אלא אחד פירש״י משום דחד מהנך קראי לאו להכי אתא דקי״ל לא נכתבו שני מקראות לטעם אחד הילכך חד מינייהו מטעא טעי.

**ומ"ש רבינו אפילו משני מקראות** כלומר לא מיבעיא אם הם ממקרא אחד דלא חשיבי אלא כחד אלא אפי' אם אמרו שניהם טעם אחד משני מקראות לא חשיבי אלא כחד מהטעם שכתבתי ובזה אין מקום למה שהשיג הרמ"ך:

**אמר אחד מהתלמידים וכו'.** משנה בסנהדרין פרק היו בודקין (סנהדרין דף מ') אמר אחד מהתלמידים יש לי ללמד עליו חובה משתקין אותו אמר יש לי ללמד עליו זכות מעלים אותו ומושיבין אותו עמהם ולא היה יורד משם כל היום ובגמ' (דף מ״ב) והתניא אם יש ממש בדבריו [לא היה יורד משם לעולם ואם אין ממש בדבריו] אינו יורד כל היום וכו' אמר אביי תרגימה אאין ממש בדבריו.

**כיצד אמרו הבא על הערוה וכו'.** שם אההיא דר' יוחנן דבסמוך היכי דמי אין חוזרין אמר ר' אבהו אמר ר' יוחנן כגון שטעה שלא כדרכה שאין הצדוקים מודים בו ובפ"ק דהוריות (דף ד') גרסינן אמר שמואל אין ב"ד חייבים עד שיורו בדבר שאין הצדוקים מודים בו:
