**מי שנגמר דינו וכו' עד אפילו יודע בעצמו ששקר העידו עליו וכך הוא מתודה.** משנה פרק נגמר הדין (סנהדרין דף מ״ב:) ואע״פ שלא הזכירה במשנה (דף מ״ג) בכרוז אלא המיתה והעבירה והעדים הזכיר רבינו גם המקום והזמן שכך אמרו בגמ' אמר אביי וצ״ל ביום פלוני ובשעה פלונית ובמקום פלוני דילמא איכא דידע ואתא ומזים להו והמשנה קצרה משום דפשיטא דע״י כן ילמדו עליו זכות באמרם עמנו היה ביום פלוני.

**ומה שכתב ועדיו הם ההורגין אותו וכו'. ומה שכתב ורוצח שלא הרגוהו עדיו כו'.** נלמד ממאי דתניא בפרק נגמר הדין (סנהדרין דף מ״ה:) מות יומת המכה רוצח הוא אין לי אלא במיתה הכתובה בו מנין שאם אי אתה יכול להמיתו במיתה הכתובה בו שאתה ממיתו בכל מיתה שאתה יכול להמיתו תלמוד לומר מות יומת המכה מ״מ ואסיקנא התם דלא גמרינן מרוצח משום דהוו רוצח וגואל הדם שני כתובים הבאים כאחד ואין מלמדין ובפי״ד הארכתי בדין זה על דברי רבינו עיין שם:

**אין ב״ד יוצאין וכו'. . וכל ב״ד שהרגו וכו'.** פ' ד' מיתות (סנהדרין דף ס״ג) ר״ע אומר מנין לסנהדרין שהרגו את הנפש שאין טועמין כל אותו היום תלמוד לומר לא תאכלו על הדם:

**מי שנגמר דינו וברח וכו' עד ה"ז יהרג.** משנה ספ"ק דמכות (דף ז') מי שנגמר דינו וברח ובא לפני אותו ב"ד אין סותרין את דינו כל מקום שיעמדו שנים ויאמרו מעידים אנו באיש פלוני שנגמר דינו בב"ד של פלוני ופלוני ופלוני עדיו הרי זה יהרג ומה ששינה רבינו וכתב ובא לב"ד אחר יתבאר בסמוך:

**במה דברים אמורים ברוצח וכו'.** בסנהדרין פ' נגמר הדין (סנהדרין דף מ״ה:) אמר שמואל נקטעה יד העדים פטור והקשו עליו מהא דתנן כל מקום שיעמדו שנים ויאמרו וכו' תרגמה שמואל בהן הן עדיו כלומר שאותם שמעידין שנגמר דינו הם עדיו הראשונים שהעידו עליו בבית דין ונתחייב על פיהם ובתר הכי אוקימנא להא דשמואל בשאר חייבי מיתות לבד מרוצח וממילא כי אוקימנא למתניתין בהן הן עדיו דוקא בשאר חייבי מיתות דומיא דשמואל אבל ברוצח אפילו אינן עדיו הראשונים.

**ומה שכתב ויהרגוהו בידם דכתיב יד העדים תהיה בו בראשונה וכו'. ומה שכתב והוא שיעידו עליו בבית דין של כ"ג.** פשוט דאין הורגין אלא בבית דין של כ"ג:

**מי שנגמר דינו בב"ד של חוצה לארץ וכו'.** בסוף פ"ק דמכות (דף ז') הקשו במשנה שכתבתי בסמוך רישא אסיפא דמרישא משמע דלפני ב"ד אחר סותרין דינו ומסיפא משמע דאפילו לפני ב"ד אחר אין סותרים דקתני כל מקום ואמר אביי ל"ק כאן בארץ ישראל כאן בחוצה לארץ דתניא רבי יהודה ברבי דוסתאי אומר משום ר' שמעון בן שטח ברח מארץ ישראל לחוצה לארץ אין סותרין דינו מח"ל לארץ סותרין את דינו מפני זכותה של ארץ ישראל ובבבא זו כתב רבינו דין נגמר דינו בחוצה לארץ וברח לארץ ישראל ובבא שקודם זו המתחלת מי שנגמר דינו וברח לב"ד אחר כתב דין נגמר דינו בארץ ישראל וברח לחוצה לארץ ולכך כתב שם וברח לב"ד אחר דכל שלא ברח מחוצה לארץ לארץ ל"ש לן בין אותו ב"ד לב"ד אחר דבכל מקום אין סותרין את דינו:
