**מי שנגמר דינו וכו'.** משנה שם רוצח שנתערב באחרים כולם פטורים רבי יהודה אומר כונסין אותו לכיפה ובעו בגמרא מאן אחרים ואמר שמואל דפלוגתייהו ברוצח שלא נגמר דינו שנתערב באחרים שנגמר דינם ופטרי רבנן משום דאין גומרין דינו של אדם אלא בפניו וכיון דאין מכירין אותו ה"ל שלא בפניו וידוע דהלכה כרבנן ור"ל ס"ל דבהא כולי עלמא לא פליגי דפטירי ורבה נמי משמע דהכי ס"ל דבהא כולי עלמא לא פליגי דפטירי ואם כשנתערב מי שלא נגמר דינו עם מי שנגמר פטור כל שכן כשנתערב מי שנגמר דינו עם שאר העם דפטירי אבל מכל מקום יש לדקדק בלשון רבינו למה לא כתב מי שנגמר דינו שנתערב עם שאר העם או עם מי [שלא] נגמר דינו ולא נודע מי הוא כולן פטורין והיה מקצר יותר. ודע שמה

**מי שעמד על נפשו וכו'.** סנהדרין פרק נגמר הדין (סנהדרין דף מ״ה:) אמר שמואל נקטעה יד העדים פטור מ״ט דבעינן יד העדים בראשונה וליכא אלא מעתה עדים גדמים דמעיקרא הכי נמי דפסילי שאני התם דאמר קרא יד העדים שהיתה כבר וכו' ומי בעינן קרא כדכתיב והתניא מות יומת המכה רוצח הוא אין לי אלא במיתה הכתובה בו מניין שאם אי אתה יכול להמיתו במיתה הכתובה בו שאתה ממיתו בכל מיתה שאתה יכול להמיתו ת״ל מות יומת המכה מ״מ שאני התם דאמר קרא מות יומת ופירש״י יד העדים יד שהיתה להם תהיה להם בשעת מיתה אבל גדמים מעיקרא לא משתמע מיניה דזו היא יד שלהם וכו' אין לי אי לא כתב אלא יומת אלא מיתה הכתובה בו סייף עכ״ל. ולפום ריהטא משמע דרוצח משום דכתיב ביה מות יומת אשתני משאר חייבי מיתות בתרתי חדא דשאר חייבי מיתות בעינן דלא ימיתנו אלא במיתה הכתובה בו ורוצח אתה ממיתו בכל מיתה שאתה יכול תרתי דבשאר חייבי מיתות בעינן יד העדים בראשונה ואילו ברוצח לא בעינן דמדמקשה מההיא דרוצח אתה ממיתו בכל מיתה שאתה יכול משמע דהא בהא תליא דאי בעינן יד העדים בראשונה אי אתה ממיתו בכל מיתה שאתה יכול ואי אתה ממיתו בכל מיתה שאתה יכול לא בעינן יד העדים בראשונה ויש לתמוה על רבינו שכתב שגם בשאר מחוייבי מיתה ממיתין אותם בכל מיתה שיכולין ואין חילוק בין רוצח לשאר אלא אי בעינן יד העדים בראשונה אי לא דלדידיה מאי מקשה לשמואל מרוצח שאתה ממיתו בכל מיתה שאתה יכול דהא בשאר מחוייבי מיתה הכי דינא אלא שיד עדים בראשונה בעינן וה״ה גבי רוצח ואפשר לומר דכי מקשה לשמואל לישנא דברייתא דייק דקאמר שאם אי אתה יכול להמיתו דמשמע דקאי לבית דין או לכל אחד מישראל דכל הקודם בו זכה דאי קאי לעדים שאם אינם יכולים להמיתו מיבעי ליה אלא משמע דלא בעינן יד עדים בראשונה וקשיא לשמואל אבל אה״נ דשאר חייבי מיתות נמי הוי דינא דממיתין אותו בכל מיתה אלא דבעינן יד עדים בראשונה ואין לי אלא מיתה הכתובה בו פירוש יד העדים בראשונה ושני ליה דשאני רוצח דכתיב ביה מות יומת לרבות אפי' דליכא יד עדים בראשונה. ויש לדקדק שתפס רבינו דין דנקטעה יד העדים גבי מי שעמד על נפשו דמשמע דאם לא עמד על נפשו חייב ולפום סוגיין משמע דשמואל סתם מיירי בין עמד על נפשו בין לא עמד:
