**ומה שכתב ומכסין ערותו מלפניו** הכי איתא במשנה האיש מכסין אותו מלפניו והאשה מלפניה ומאחריה דברי ר' יהודה וחכמים אומרים האיש נסקל ערום ואין האשה נסקלת ערומה וסבירא ליה לרבינו דלא פליגי אלא באשה אבל באיש כולי עלמא מודו דמכסין אותו מלפניו ואף על פי שהוא מכוסה מלפניו קראוהו ערום ופסק כחכמים.

**ומה שכתב ואם לא מת מדחיפה זו מגביהים העדים אבן שהיתה מונחת שם משא שני בני אדם והעד השני מרפה ידו וכו'.** ברייתא שם ותמהני למה לא כתב רבינו כמו ששנינו במשנה דוחפו על מתניו כלומר דוחפו על מתניו מאחוריו והוא נהפך ונופל על לבו וחוזר והופכו על מתניו וכתב רש"י הטעם שכשהוא מושכב פרקדן מגונה יותר ואפשר גם כן שהטעם כדי שיהיה לבו לצד מעלה שבכדי שהעד השני יטול את האבן ויתנה על לבו ולפיכך לא חשש רבינו לכתבו מכיון שכתב בסמוך מגביהין העדים אבן וכו' ומשליך האבן על לבו שפשיטא שאז לבו לצד מעלה גם קיצר שלא פירש שדוחפין אותו מעומד כדי שיפול ממקום יותר גבוה כי כך אמרו בגמרא:

**ומ"ש ותולהו סמוך לשקיעת החמה** יצא לו ממה שאמרו שם (ע"ב) בברייתא משהין אותו עד סמוך לשקיעת החמה וגומרין דינו וממיתין אותו ואחר כך תולין אותו. ויש לדקדק שרבינו לא כתב שממיתין אותו סמוך לשקיעת החמה כמו שאמרו בברייתא אלא כתב ותולהו סמוך לשקיעת החמה שנראה שאין הקפידא אלא שיתלוהו סמוך לשקיעת החמה וכבר אפשר שימיתוהו מבעוד יום. ויש לומר שמאחר שכתב אחר שסוקלין אז משקעין את הקורה וכו' משמע שתיכף לסקילה תליה וכיון שכתב שתולהו סמוך לשקיעת החמה ממילא משמע שסקילתו הויא קרוב לשקיעת החמה:

**אין תולין וכו'.** שם תנו רבנן עץ שומע אני בין בתלוש בין במחובר תלמוד לומר קבור מי שאינו מחוסר אלא קבורה יצא זה שמחוסר קציצה וקבורה ורבי יוסי אומר מי שאינו מחוסר אלא קבורה יצא זה מי שמחוסר חפירה תלישה וקבורה כלומר דאף נעוץ נתמעט מן המשמע הזה ורבנן תלישה לאו כלום היא כלומר אין כאן חסרון מעשה ומדברי רבינו נראה דדוקא מחובר לקרקע ממעט אבל לא נעוץ ואתי כרבנן:

**שהעץ שנתלה עליו וכו'.** ברייתא שם (דף מ"ה ע"ב) דכל הני נקברים עמו והתניא אין נקברים עמו אמר רב פפא מאי עמו בתפיסתו:
