**שנים שבאו לפניך לדין וכו'.** פירקא קמא דסנהדרין (דף ז') תניא רבי שמעון בן לקיש אומר שנים שבאו לפניך אחד רך ואחד חזק וכו' אבל משתשמע דבריהם וכו' שנאמר לא תגורו מפני איש ואמר רב חנן אל תכניס דבריך מפני איש ומפרש התם דדריש ליה מלשון אסיפה כמו ולא תאגור:

**מצוה לומר לבעלי דינין וכו' במה דברים אמורים וכו'.** פירקא קמא דסנהדרין (דף ו' ע"ב) רבי יהושע בן קרחה אומר מצוה לבצוע ודריש לה ממשפט שלום ומקרא דדוד ואמרינן מאי מצוה מצוה למימר להו הכי דינא בעיתו או פשרה בעיתו ואמרינן התם ודוקא מקמי גמר דין אבל לאחר גמר דין אי אתה רשאי לבצוע ואמרינן היכי דמי גמר דין אמר רב יהודה אמר רב (מכי אמר) איש פלוני אתה חייב איש פלוני אתה זכאי:

**יפה כח הפשרה וכו'.** ריש סנהדרין (דף ה':) תניא רבן שמעון בן גמליאל אומר הדין בשלשה פשרה בשנים יפה כח הפשרה וכו'. וכתבו המפרשים דלאו דוקא שנים דהוא הדין אחד דכיון דקיימא לן דבעי קנין ביחיד נמי מהניא. ואיכא למידק מה יפוי כח יש בפשרה מבדין דכיון דפשרה מיירי בשקנו מידן הלא דין ג"כ אם קנו מידם שידון להם אחד אפילו קרוב או פסול אינם יכולים לחזור בהם כמבואר בפרק שביעי. ויש לומר דכיון דסתם דין לא בעי קנין וכל פשרה בעיא קנין שפיר מצי למימר יפה כח פשרה העשויה כמשפטה דהיינו בקנין מכח הדין העשוי כמשפטו דהיינו בלא קנין. ומיהו איכא למידק דהא דתניא תו התם (דף ז') ביצוע בשלשה דברי ר"מ וחכמים אומרים פשרה ביחיד אמרינן לימא תלתא תנאי בפשרה דמ"ס בשלשה ומ"ס בשנים ומ"ס ביחיד אמר רב אחא בר איקא וכו' מאן דאמר תרי אפילו חד נמי והא דקאמר תרי כי היכי דליהוו עליה סהדי וכיון דגמ' מסיק דלרשב"ג נמי פשרה ביחיד ס"ל למה פסק רבינו דבפשרה שנים. ויש לומר דסבר רבינו דלא איתמר הכי אלא למדחי דלא נימא דתלתא תנאי בפשרה אבל פשטא דמילתא דרשב"ג דפשרה בשנים דוקא היא ולא ביחיד וכן נראה מדברי הרי"ף שכתב דברי רשב"ג סתם. אלא דאכתי איכא למידק אמאי פסק כרשב"ג דאמר בשנים כחכמים דאמרי ביחיד הוה ליה למיפסק וצ"ע:

**אסור לאחד מהדיינים וכו'.** בסנהדרין פרק זה בורר (סנהדרין דף כ״ט) משנה ומנין שכשיצא אחד מן הדיינים לא יאמר אני הוא המזכה וכו':

**שאל אחד מבעלי דינין וכו'.** שם (דף ל') מיכתב היכי כתבינן ר' יוחנן אמר זכאי רשב"ל אמר פלוני ופלוני מזכין (פלוני) ופלוני מחייב ר' אלעזר אמר מדבריהם נזדכה פלוני ופירש"י היכי כתבינן פסק דין במקום שיש מחלוקת ונטו אחרי רבים זכאי סתמא משום שאם היו אומרים פלוני מחייב היה רכילות ורשב"ל חייש למיחזי כשיקרא אי אמר סתמא זכאי דהוה משמע דכולהו זיכו הדין כאחד ורבי אלעזר אומר כדי להעמיד דברי שניהם כותבים מדבריהם נזדכה דמשמע דיש מחלוקת ביניהם ומתוך דבריהם נזדכה והשתא ליכא משום מיחזי כשיקרא ולא משום הולך רכיל וכתב הרא"ש והלכתא כר"א דאית ליה דתרווייהו ומסתבר טעמיה:
