**כל המקלל דיין וכו'.** בסוף פ' ארבע מיתות (סנהדרין דף ס״ו) אלהים לא תקלל היינו הדיין ואמרי' בגמרא דאפי' לר' אליעזר בן יעקב דאמר האי אלהים קדש הוא והוי אזהרה למברך את השם יליף נמי דיין מהכא לא תקלל ולא כתיב ולא תקל.

**ומ"ש וכן אם קלל הנשיא אחד ראש הסנהדרין או המלך.** למדה מדתנן בהוריות ואי זהו הנשיא זה המלך שנאמר ועשה אחת מכל מצות ה' אלהיו נשיא שאין על גבו אלא ה' אלהיו אמרי' דדוקא התם דכתב ה' אלהיו אמרי' דוקא מלך אבל היכא דלא כתיב לאו דוקא אלא הוא הדין לראש הסנהדרין. אחר שכתבתי זה מצאתי במכילתא אלהים לא תקלל אין לי אלא דיין נשיא מנין ת"ל נשיא בעמך לא תאור:

**ולא דיין ונשיא בלבד וכו'.** בפ' שבועת העדות (שבועות דף ל״ה) תנן המקלל עצמו וחבירו בכולן עובר בלא תעשה ובגמ' (דף ל״ו) חבירו דכתיב לא תקלל חרש ומשום דלא תיקשי לן מה לחרש שכן חרישותו גרמה לו כלומר שאפי' שהוא שפל הזהירה תורה על קללתו אבל לא הזהירה לאיניש דעלמא לכך כתב רבינו ולמה נאמר חרש וכו' והוא ממה ששנינו בפסיקתא ולא תקלל חרש מרבה אני אפילו בר ישראל שאינו שומעך ק״ו לפניו:

**ויראה לי שהמקלל הקטן הנכלם לוקה.** למדה רבינו מדאמרינן בהחובל (דף פ"ו) דקטן דמכלמינן ליה ומיכלם יש לו בשת וסובר רבינו דהוא הדין לענין קללה, ובטור ח"מ סי' כ"ז גורס המקלל את הישן חייב מפני שהוא כחרש וגירסא נכונה היא:

**המקלל את המת פטור.** מדאיצטריך בפ' אלו הן הנחנקין (סנהדרין דף פ״ה ע״ב) למילף דחייב על קללת אביו ואמו לאחר מיתה אלמא דבשאר כל אדם פטור ובת״כ לא תקלל חרש אין לי אלא חרש מנין לרבות כל אדם תלמוד לומר ונשיא בעמך לא תאור אם כן למה נאמר חרש מה חרש מיוחד שהוא בחיים אף כל שהוא בחיים יצא המקלל את המת שהוא פטור:

**הואיל ומקלל כל אדם מישראל חייב וכו' וכן נשיא שקלל אביו חייב וכו'.** במכילתא על פסוק אלהים לא תקלל.

**ואחד המקלל עצמו או וכו'.** משנה שם (דף ל"ה:) המקלל עצמו וחבירו בכולן פירוש בכל השמות והכנויים עובר בל"ת ומשמע דכל שאינו בשם או כינויי אינו עובר בל"ת והוא הדין לנשיא ודיין שאינו לוקה עד שיקללם בשם. והנה הראב"ד כתב על דברי רבינו א"א אינו לוקה אלא בשם המיוחד וכו'. ואני אומר שפשט הירוש' כדברי רבינו דהכי איתא התם (שבועות ספ"ד) המקלל עצמו וחבירו בכולן עובר בלאו מהו ללקות חברייא אמרי אינו לוקה אמר לון רבי יוסי למה שהוא ל"ת שאין בו מעשה והרי הממיר והנשבע לשקר לאו שאין בו מעשה עד כאן. ומשמע שר' יוסי בא לחלוק על דברי חברייא ואמר למה אתם אומרים שאינו לוקה מפני של"ת שאין בו מעשה הוא אין זו טענה שהרי הממיר והנשבע לשקר לאו שאין בו מעשה ואפ"ה לוקין עליו וה"ה למקלל עצמו וחבירו וכדיהיב טעמא בריש תמורה והראב"ד נראה שמפרש שלא אמרו חברייא אינו לוקה אלא בשאר שמות חוץ משם המיוחד ור' יוסי מתמה אמאן דבעי מהו ללקות דמהיכא תיסק אדעתין ללקות ואפי' על שם המיוחד כיון דלאו שאין בו מעשה הוא והשיבו לו שבדין הוא לוקה על שם המיוחד אע"פ שאין בו מעשה כדאשכחן בממיר ונשבע לשקר וכטעמא דיהיב בריש תמורה:

**וארור בו שבועה וכו'.** גם זה שם ומייתי לה התם מקראי ופירש"י צריך אדם לפרוש ממנו אם א"ל חכם ארור בלשון נדוי ואם אמר אדם לחבירו לשם שבועה וקבלו עליו שבועה היא והמקלל את חבירו בלשון ארור הוא לה' קללה היא וחייב:

**אינו לוקה עד שיתרו בו וכו'.** נראה לי דסד"א דכיון דמקלל חבירו חידוש הוא דלאו שאין בו מעשה אין לוקין עליו התראה נמי לא ניבעי קמשמע לן אי נמי ה"א דכיון דאורחא דקללה בריהטא ובכעס הוא לא ניבעי התראה קמשמע לן:

**היתה יד עכו״ם וכו'.** למדוה הפוסקים מדאמרינן בסוף החובל (בבא קמא דף צ״ב:) קרית חברך ולא ענך רמי גודא שדי ביה פירש״י כותל הפל עליו כלומר הניחו ויפול ברשעו דחהו בידים, הכי נמי כיון דלא ציית דינא יביאהו בערכאותיהם אבל אי ציית דינא אין לו להביאו בערכאותיהם כדבסמוך:
