**וכתב** בהשגות א"א ולמה לא מנה הממונה על הפקיע והוא מכין הפתילות:

**ואני** אומר אמת הדבר כי בירושלמי פירשו מה ששנינו במשנה הנזכרת בן בבי על הפקיע כמו שפירש הראב"ד אבל בגמרא דידן פ"ב דיומא (דף כ"ג) אמר אביי מריש ה"א הא דתנן בן בבי (ממונה) על הפקיע פתילתא וכו' כיון דשמענא להא דתניא ולא עוד אלא שלוקה מן הממונה בפקיע אמינא מאי פקיע נגדא ופירש"י נגדא רצועות מלקות ורבינו תפס כגמרא דידן שדחה פירוש הירושלמי מכח הברייתא. ויש לתמוה על הראב"ד למה תפס על רבינו שעשה כהוגן וכשורה ובמקום דנמטייה אפריון השיגו ואין לומר שתמה עליו למה לא מנה גם הממונה על הכנת הפתילות דא"כ ה"ל י"ו ממונים ותנא דמתני' לא מני אלא ט"ו:

**ומ"ש ובע"ש מוסיפין שש ג' וכו' עד בשעה שמנסכין המים.** שם במשנה ע"ש שבתוך החג היו שם שמנה וארבעים תקיעות שלש לפתיחת שערים שלש לשער העליון שלש לשער התחתון שלש למילוי המים ושלש על גבי המזבח ט' לתמיד של שחר ט' לתמיד של בין הערבים ט' למוספין ג' להפטיר את העם וג' להבדיל בין קדש לחול. ופירש"י ג' לשער עליון דאמרן לעיל גבי שמחת בית השואבה עמדו שני כהנים בשער העליון היורד מעזרת ישראל לעזרת הנשים קרא הגבר תקעו והריעו ותקעו. ג' לשער התחתון דאמרן לעיל הגיעו לעזרה תקעו והריעו ותקעו והיו מאריכים בהם עד שהגיעו לשער היוצא למזרח והוא שער התחתון וכו'. ג' למילוי המים אחר שמילאו ושבו ובאו להם לעזרה דרך שער המים ותנן בפרק לולב וערבה הגיעו לשער המים תקעו והריעו ותקעו עכ"ל. ומדברי רבינו נראה שהוא מפרש דלשער התחתון דקתני היינו לפתיחת שער העליון ולפתיחת שער התחתון:

**ומ"ש ואם היה מצורע עשיר מביא ג' עשרונין ולוג שמן** ואין דוגמתו כשאר החותמות אבל מצורע עני אינו טעון להביא אלא עשרון אחד כמו שטעון הגדי ולכן נותנין לו חותם של גדי.

**ומ"ש רבינו ושם כל היום כתוב על החותם וכו' עד שיוקרו הנסכים.** שם במשנה ושם (כל) היום כתוב עליהם מפני הרמאין ופירוש רבינו בה נכון וכן פירש בפי' המשנה וכתב שם עוד פירוש אחר והוא כדי שלא ימצא חותם שנפל קודם לכן לבעליו או לאחיה או ליוחנן ויגבה בו ואין אותו פי' נכון כ"כ משום דא"כ למה לכתוב שם היום יכתבו שם בעליו ודי והראב"ד כתב על דברי רבינו לא כי אלא שמא יעשנו אובד ויבא לידי אחר ויוציא חותמו ואין לומר שהוא מפרש כאותו פי' אחר שכתב רבינו בפי' המשנה דא"כ מאי שמא יעשנו אובד דקאמר שמא יאבדנו מיבעי ליה ויש ספר שהוגה בהשגת הראב"ד ליום אחר במקום לידי אחר וטעמו לומר שמא יצניענו ויאמר שאבד ממנו ויתבע מהממונין שיחזירו לו הדמים שנתן וימצאו דמי החותם ההוא יתר על החותמות הנמצאים ויחזירום לו וביום אחר יוציא אותו חותם ויתנו לו נסכים כדי אותו חותם. ומ"מ יש לתמוה גם בהשגה זו גם בקודמת למה דחה פי' רבינו לומר לא כי אלא בהיות פי' רבינו מתיישב ג"כ:

**ומ"ש והשכר שמשתכר ההקדש בשערים וכו'.** בפ"ד דשקלים (משנה ד') תנן ר"ע אומר מותר תרומה קיץ למזבח מותר נסכים לכלי שרת רבי חנינא סגן הכהנים אומר מותר נסכים קיץ למזבח ומותר התרומה לכלי שרת וכתב שם רבינו עוד יתבאר לך בפרק שאחר זה כי הנסכים היה הקדש משתכר בהם והיה מתקבץ ממנו דמים יתרים והם נקראים מותר נסכים ופסק רבינו כרבי חנינא. ויש לתמוה דהא קי"ל הלכה כר"ע מחבירו ואפשר שטעמו משום דכיון דרבי חנינא סגן הכהנים הוה מסתמא במילי דמקדש טפי הוה בקי מר"ע.
