**ומה שכתב ואם עבר וקינא לה וכו' הרי זה קינוי.** יש לתמוה דהתם בירושלמי איבעיא לן עבר וקינא לה באחד מכל הדברים הללו מה את אמרת למצוה לעיכוב אין תימר למצוה קינויו קינוי אין תימר לעיכוב אין קינויו קינוי אתיא כהדא כל מקום שנאמר חוקה תורה מעכב הקינוי ומשמע דהכי קאמר דהא דכתיב בפרשת סוטה זאת תורת הקנאות מעכב ויש לומר דמשמע לרבינו דכי כתיב זאת תורת הקנאות אמאי דכתיב בסיפא דקרא ועשה לה הכהן את כל התורה הזאת קאי ולא אקינוי ועי"ל דשלא יקנא לה מתוך שחוק וכו' אינו מפורש בכתוב דנימא דקאי עליה:

**אין ראוי לקפוץ ולקנאות בפני עדים תחלה וכו'.** בריש סוטה (דף ב':) א"ר חנינא מסורא לא לימא איניש לאיתתיה בזמן הזה אל תסתרי בהדי פלוני דילמא קי"ל כר"י בר' יהודה [משום ר' אליעזר] דאמר קינוי ע"פ עצמו [ומיסתתרא] וליכא האידנא מי סוטה למיבדקה וקאסר לה עילויה איסורא דלעולם ואע"ג דלפום דינא לא קי"ל אלא כרבי יהושע דפליג על רבי אליעזר ואמר מקנא לה ע"פ שנים ומשקה ע"פ שנים למד משם רבינו מדברי רבי חנינא לדידן שלא יקפוץ לקנאות לה בפני עדים תחלה.
