**יש** לדיין לדון בדיני ממונות על מה שדעתו נוטה לחשוד את האחד בשבועה או לפגום את השטר או להוציא פקדון מיד שמוחזק בו שהוא שלו דכתיב ועמכם בדבר המשפט אין לדיין אלא מה שעיניו רואות ולא הצריכה תורה שני עדים אלא שידון על פי עדות אף ע"פ שאינו יודע אם אומר אמת או שקר ומשרבו בתי דינין שאינם הגונים הסכימו שלא ידון הדיין בסמיכת דעתו ולא באומדן אבל אם יודע בדין שהוא מרומה יסתלק ולא יאמר הקולר תלוי בצואר העדים דכתיב מדבר שקר כדאמרינן פרק שבועת העדות.
