**הטועה** בדבר משנה חוזר הדין ודנין בו כהלכה דלא תימא דבדיעבד מה שעשה עשוי מדאוריתא דלכתחלה הוא דדיינינן הכי כדכתיב לא תטה משפט דמשמע לכתחלה דהא כל דיני התורה אפילו בדיעבד נמי הוו דכל דאמר רחמנא לא תיעביד אי עביד לא מהני וכיון דדבר מפורש הוא אין דינו דין והוא פטור דהתורה צותה עליו שידון ולא נתכוון להזיק ואם היה מומחה ויש לו רשות לדון וטעה בשיקול הדעת ליביה אנסיה ופטור כשאין יכול להחזיר ואם לא היה לו רשות לדון ונשא ונתן ביד ישלם מביתו ומה שעשה עשוי וכן מי שאינו מומחה וקבלוהו בעלי דינין עליהם ואם לא קבלו אותו הוי כמתכוין להזיק.
