הַמַּפְקִיד מָעוֹת אֵצֶל חֲבֵרוֹ, עַתָּה בַּזְּמַן הַזֶּה שֶׁכָּל עֲסָקֵינוּ בְּמַשָּׂא וּמַתָּן וְהַכֹּל צְרִיכִין לְמָעוֹת, מִן הַסְּתָם נִתְרַצָּה הַמַּפְקִיד, שֶׁהַנִּפְקָד יוֹצִיאֵן כְּשֶׁיִצְטָרֵךְ. וְלָכֵן מֻתָּר לוֹ לְהוֹצִיאָן, וַהֲרֵי הֵן אֶצְלוֹ כְּמוֹ מִלְוֶה, אֶלָּא אִם כֵּן גִּלָּה הַמַּפְקִיד דַּעְתּוֹ שֶׁאֵין רְצוֹנוֹ בְּכָךְ, כְּגוֹן שֶׁחֲתָמָן אוֹ קְשָרָן בְּקֶשֶׁר מְשֻׁנֶּה, אָז אֵין הַנִּפְקָד רַשַּׁאי לְהוֹצִיאָן.

If you deposit money with your neighbor, since most of us are involved in business, and we always need money, it is assumed that you agree that the depositary may use that money if he needs it. Therefore, the despositary is permitted to use the money, and the money is considered by him as a loan, unless you indicate to him that you do not wish it to be used. For instance, if you put the money in a sealed package, or tied it up with a special knot, the depositary is not permitted to use it.

הַמַּפְקִיד שְׁאָר חֵפֶץ אֵצֶל חֲבֵרוֹ, אָסוּר לְהַנִּפְקָד לְהִשְּׁתַּמֵּשׁ בְּחֵפֶץ זֶה לְצָרְכּוֹ. וְאַף עַל פִּי שֶׁאֵין הַחֵפֶץ מִתְקַלְקֵל כְּלָל בְּתַשְׁמִישׁ זֶה, מִכָּל מָקוֹם הֲוֵי שׁוֹאֵל שֶׁלֹּא מִדָּעַת. וְשׁוֹאֵל שֶׁלֹּא מִדַּעַת, גַּזְלָן הוּא. וְאִם יָדוּעַ בְּבֵרוּר שֶׁאֵין הַמַּפְקִיד מַקְפִּיד עָלָיו, מֻתָּר. וְיֵשׁ אוֹסְרִין גַּם בָּזֶה, מִשּׁוּם דְּפִקָּדוֹן אֲפִלּוּ בְדָבָר שֶׁאֵין דֶּרֶךְ בְּנֵי אָדָם לְהַקְפִּיד, אָסוּר, מִשּׁוּם דַּהֲוֵי שׁוֹלֵחַ יָד בַּפִּקָּדוֹן גַּם בִּכְהַאי גַּוְנָא. וְיֵשׁ לְהַחְמִיר.

If someone deposits an article with you, you are forbidden to use that article for your own needs even though the article will not spoil in the least by such use. Nevertheless, you would be borrowing it without the owner's knowledge, and he who borrows without the owner's knowledge is considered a robber. If you know definitely that your depositer would not object to your using it, you are permitted to use it. Some *Poskim* prohibit this too, because with regard to a deposit, it is forbidden to use even something whose use people generally do not object to, because it is considered a fraudulent use of a deposit even in such circumstances. You should follow the stricter opinion.

חַיָב לִשְׁמֹר אֶת הַפִּקָּדוֹן בְּאֹפֶן הַיוֹתֵר טוֹב כְּפִי הַדֶּרֶךְ לִשְׁמֹר חֲפָצִים כָּאֵלּוּ. וַאֲפִלּוּ אִם הוּא אֵינוֹ מְדַקְדֵק כָּל כָּךְ בִּשְׁמִירַת חֲפָצִים שֶׁלּוֹ בַּפִּקָּדוֹן, חַיָב לְדַקְדֵּק יוֹתֵר.

It is your duty to safeguard the deposit in the most effective manner, in accordance with the accepted manner of safeguarding such articles. Even though you are not so particular to guard your own property so carefully, nevertheless with property entrusted to you, you must take special care.

אֵין הַנִּפְקָד רַשַּׁאי לְהַפְקִיד אֶת הַפִּקָּדוֹן בְּיַד אֲחֵרִים, אֲפִלּוּ כְּשֵׁרִים וְנֶאֱמָנִים יוֹתֵר מִמֶּנּוּ, אֶלָּא אִם כֵּן הַמַּפְקִיד גַּם כֵּן רָגִיל לְהַפְקִיד דְּבָרִים כָּאֵלּוּ אֶצְלָם.

You are not permitted to entrust the deposit with other people, even though they are more fit and trustworthy than yourself, unless the depositor is also accustomed to entrust these kinds of things with them.

כְּשֶׁבָּא לְהַחֲזִיר אֶת הַפִּקָּדוֹן, לֹא יַחֲזִירֶנּוּ לְאֶחָד מִּבְּנֵי בֵיתוֹ שֶׁל הַמַּפְקִיד שֶׁלֹּא מִדַּעְתּוֹ. וְכֵן כְּשֶׁבָּא לְהַחֲזִיר לוֹ אֵיזֶה חֵפֶץ שֶׁהִשְׁאִיל לוֹ אוֹ לִפְרֹעַ חוֹבוֹ. אֲבָל יָכוֹל לְהַחֲזִיר לְאִשְׁתּוֹ, כִּי מִן הַסְּתָם הִיא נוֹשֵׂאת וְנוֹתֶנֶת בְּתוֹךְ הַבַּיִת, וְהַבַּעַל מַפְקִיד כָּל אֲשֶׁר לוֹ בְּיָדָהּ.

When you return the deposit, you should not return it to any member of the depositor's household without his consent. This is also true when you return any article that was lent to you, or when you pay a debt. However, you may return it to his wife, as it may be assumed that she manages the household, and her husband entrusts everything with her.
