**האומר לחבירו.** מלשון זה הכריח הכ"מ דהר"מ מפ' המתני' אלך ואעבוד קאי על המסית אבל סוגית הגמרא סנהדרין ס"א מוכח דמפרש המתני' דקאי על המוסת שאמר אלך ואעבוד ומקבל עליו וכן פירש"י שם, ועיין תוס' יו"ט פ"ז דסנהדרין מ"י שכבר העיר בזה:

**ואין המסית צריך התראה.** עיין תוס' סנהדרין (דף ח' ע"ב) ד"ה בעדה כו'. למ"ש דמסית נמי צריך עדים והתראה אלא הא דאמרו לו האיך נניח היינו התראה, ועיין בס' משנת חכמים (דף ס"ח ע"ג) שהאריך:

**אסור למוסת לאהוב את המסית שנאמר לא תאבה לו.** הוא דרשת הספרי הובא ברש"י עה"ת ורמב"ן שם כתב דהגמרא חולק בזה סנהדרין (דף ס"א) דדרשינן הא אם אבה ושמע חייב משמע דקאי על המוסת אזהרה, ורבינו סובר דלא פליגי דודאי פשטא דקרא הוא אזהרה אם אבה ומרוצה דחייב כמ"ש רבינו הל' ה' אלא משינוי לשון דרשינן ג"כ לא יאהב ואינו עוזר לו דהחמיר רחמנא במסית:
