בעבודתי בוועדת הבחירות האזורית לאזור תל־אביב־יפו הגיעו לידיעתי מקרים בהם ניסו מפלגות שונות לרכוש קולות על ידי הבטחת טובות הנאה כספיות ועל ידי קבלת הבטחות להצבעה עבור מפלגות מסויימות וחיזוק ההבטחה על ידי נדר, שבועה ואף שבועה על ספר תורה או על ספר הזוהר.

ברובם המכריע של המקרים אין ביד השלטונות לגלות מקרים אלה מאחר והמעורבים בדבר חוששים להעיד על כך, הן בגלל פחד כלכלי, הן בגלל חשש מעונש פלילי והן בגלל חשש מהפרת הנדר או השבועה.

כב' יסכים עמי כי במעשים אלה יש משום גניבת דעת והונאה, משום סילוף דעת העם, אף יש בהם במדה גדושה ניצול התחושה הדתית של הבוחר למטרות הנוגדות את עיקרי הצדק והמוסר.

משנה אי הגינות יש בפעולות אלה, מאחר ובהן קושרים בהתחייבות להצבעה אדם, חסר חוש ביקורת עצמית, הפוחד פחד מיסטי מהפרת שבועתו או התחייבותו.

מאחר ומאמין אני כי יגדל כבודה של תורה בישראל אם כב' יעשה למניעת ניצול הדת והקשור בה למטרות הונאה ולסילוף רצון העם המשתקף על ידי בחירות חפשיות.

אי לכך הנני פונה לכב' כי יעשה שימוש בכחו כמנהיגה הרוחני והדתי של היהדות בישראל, כי יפנה לצבור הבוחרים בישראל בקריאה להצביע איש לפי מצפונו ואיש לפי אמונתו, וכי יודיע כי כל הנדרים, השבועות וההבטחות שניתנו בדבר ההצבעה לבחירות לכנסת החמישית בטלין ומבוטלין לא שרירין ולא קיימים.

קיבלתי את מכתבו מיום כ"ב לח.ז. שבו כותב כב' שהגיעו אליו שמועות על מקרים שאנשים ממפלגות שונות המעוניינים לרכוש קולות למפלגותיהם משפיעים על הבוחר בכל מיני דרכים, ואחר קבלת הבטחתו ולחיזוק ההבטחה משביעים אותו ואפילו בנקיטת חפץ בספר הזהר ובספר תורה¹⁹; ושואל אם זה מותר לפי הדין.

אני מצטער מאד לשמוע שהדברים הגיעו עד כדי כך. ידוע שחז"ל ורבותינו הפוסקים החמירו מאד מאד שלא להשביע ולא להשבע אף על מנת לקיים. וזה לשון השלחן ערוך באורח חיים סי' קנ"ו: "ויזהר מלישבע אפילו באמת, שאלף עיירות היו לינאי המלך וכולן נחרבו בשביל שהיו נשבעים שבועות אף על פי שהיו מקיימים אותן".

ואפילו בתביעות שבין אדם לחברו בבתי הדין עושים הדיינים כל מה שאפשר שלא להשביע. ראה בשלחן ערוך חושן משפט סי' פ"ז סע' כ"א: "צריכים הדיינים לפצור בבעלי דינים אולי יחזרו בהם עד שלא תהיה שם שבועה כלל"²⁰.

רבינו יום־טוב צהלון בתשובותיו סי' רע"ד כתב: "זה דרכי כל מה שאני יכול (לעשות) שלא להביא הנשבע לידי שבועה אני עושה, שאחר שאני פוסק הדין ואומר אתה פלוני חייב לישבע, אני אומר לו איני חפץ שתשבע אפילו על האמת; קנה שבועתך בכך וכך, ואתה הטוען קנה שבועת שוא שהיא לפי דבריך בכך וכך, ותמחלו זה לזה. ובחמלת השם עלי מעולם לא השבעתי בבית דיני²¹.

כל שכן שאסור להשביע רבים, כי לא ייבצר שיימצאו בין הנשבעים כאלה שחלילה לא יוכלו לעמוד בשבועתם.
