למשרד הפנים הוגשה הודעה על יסוד אגודה, לפי סעיף 6 לחוק העותומני לאגודות, לפיה מבקשים שבעה אנשים להתאגד בתור "האגודה להקמת בית המקדש בירושלים".

בקשתני במכתבך מי"ז שבט לחוות־דעתי בענין "האגודה להקמת בית המקדש בירושלים" שמטרותיה מפורטות בתקנותיה, והריני משיב בקצרה:

בסעיף הראשון של המטרות נאמר: "הקמת בית המקדש בירושלים על־פי תורת ישראל". ענין זה הוא העיקר שהכל תלוי בו. אצמצם, איפוא, לפיכך תשובתי עליו בלבד.

מצוות בנין בית המקדש כוללת כל הזמנים וכל זמן הוא זמנה. נסתפק בהבאת דברי שנים מגדולי ישראל לפני כמאתיים שנה. ר' חיים אבן עטר בספרו "אור החיים" כתב" "ועשו לי מקדש, היא מצות עשה כוללת כל הזמנים... וצריכין היו ישראל לעשות כן אפילו בגלויות, אלא שמצינו שאסר ה' כל המקומות מעת שנבנה ביהמ"ק" (שמות כה, ח). אחריו כתב ר' דוד פארדו בפירושו לספרי, וזה לשונו: "דציווי ועשו לי מקדש הוא ציווי לאותה שעה ולדורות. והמכוון בו דמאותה שעה חייבים לעשות מקום מקדש בכל זמן, באופן שלא יהיו מאז והלאה בלא מקדש" (ספרי דבי רב, פרשת ראה, שאלוניקי תקנ"ט, דף רב ע"ג).

עתה שנגאל הבית והוחזר לשלטון ישראל הוסרו על־ידי־כך כמה מכשולים. אף־על־פי־כן אין בידינו לבנותו.

מתנאי הבנין שיהיה בנוי כמתואר בנבואת יחזקאל. והדברים שם סתומים ואין בידינו לפרשם ולבארם, כמו שכתב הרמב"ם, וזה לשונו: "וכן בנין העתיד להבנות אע"פ שהוא כתוב ביחזקאל אינו מפורש ומבואר" (הלכות בית הבחירה א, ד).

מפני זה ומטעמים אחרים כתבו כמה פוסקים שבנינו צריך להיות על־פי נביא. וכמו שמסיק כן בשו"ת חת"ם סופר (חלק יו"ד סי' רלו וחלק או"ח סי' רח).

יש סוברים שגם המזבח צריך להיבנות על־פי נביא, ועיין בשו"ת בנין ציון להר"י עטלינגר (ח"א סימן א') ועוד, וגם דבר זה יש אומרים שמעכב את בנין הבית, שהרי כל מצוות בניינו היא בעיקרה לשם הקרבת קרבנות. כדברי הרמב"ם: "מצות עשה לבנות בית לה' מוכן להיות מקריבים בו כל הקרבנות" (שם א, א). ועיין בענין זה בס' מנחת חינוך, מצווה צה.

יתירה מזאת, מצוות בנין המקדש אי־אפשר לעשותה אלא כשרוב ישראל יימצאו בארצם. וזה לשון בעל ס' החינוך: "ונוהגת מצוה זו בזמן שרוב ישראל על אדמתן. וזו מן המצוות שאינן מוטלות על יחיד, כי אם על הצבור כולו" (מצוה צה).

מחמת שהתנאים הנצרכים לבניינו של הבית, ואפילו כמה מהם ולא כל שכן כולם, אינם באפשר בימינו, נראה שמשום כך תלה הרמב"ם בניינו במלך המשיח.

ואלה הם דברי הרמב"ם: "המלך המשיח עתיד לעמוד ולהחזיר מלכות דוד ליושנה הממשלה הראשונה ובונה המקדש ומקבץ נדחי ישראל" (הלכות מלכים, פרק יא, הלכה א) ולהלן אמר: "ואם יעמוד מלך מבית דוד הוגה בתורה ועוסק במצוות כדוד אביו... ויכוף כל ישראל לילך בה ולחזק בדקה וילחם מלחמות ה', הרי זה בחזקת שהוא משיח. אם עשה והצליח וניצח כל האומות שסביביו ובנה המקדש במקומו וקבץ נדחי ישראל, הרי זה משיח בודאי". ואם לא הצליח עד כה או נהרג בידוע שאינו זה שהבטיחה עליו תורה והרי הוא ככל מלכי בית דוד השלמים והכשרים שמתו" (שם, הלכה ד, והנוסח הוא על־פי כתבי־יד ודפוסים קדומים שלא שלטה בהם הצנזורה).

מדברי הרמב"ם האחרונים יש שרצו לומר שלדעתו אפשר לבנות המקדש גם שלא ע"י מלך המשיח ולא ע"י נביא, שהרי אם נהרג אתה שומע שאינו מלך המשיח. ויש שכתבו שאם אפשר יהיה לגלות את מקום המזבח על־ידי מדידות, מותר לבנותו ויהיה ראוי להקריב עליו קורבנות הקרבים בטומאה.

מכל האמור יש להסיק כי בהתקבץ רוב ישראל בארצו, ורוב זה הוא שיסכים בדעתו לבנותו, ואין ענין הבנין נתון לרצונו של יחיד או יחידים. לכשנזכה לכך יתוועדו רבני ישראל והם שידונו ויחליטו בדבר.

מכל מקום ענין זה שהוא הגדול ביותר ליהדות והיא התכלית של חיינו ושלכך התפללנו כל הדורות ועינינו צופיות לזה כל יום וכל שעה, שמעשה אדיר ונורא זה שאין דומה לו, לא יעלה על הדעת שייעשה בידי אנשים אלא שכל האומה כולה מקצה עד קצה תתעורר למענו וייעשה על־פיה. אין זילזול גדול מכך לענין שלשמו בעלי האגודה הנ"ל מבקשים לפעול.
