ראיתי בשערי צדק הלכות ארץ ישראל להחכמת אדם שער משפטי הארץ פרק י"א סעיף י"ג שכתב להלכה וז"ל אין מוציאין כל מיני פירות מארץ ישראל חוץ לגבולותי' אפי' באותו מלכות כו'. ותמהני א"כ על הא דמוציאין מפירות א"י ומיינה לחו"ל. ועוד דאפי' בא"י גופא במקומות שחוץ לגבולות א"י, וזה כולל הנגב אסור. ואבקש ממעכ"ת הרמה שתברר לי סמך ההיתר לזה.

הטעם לאיסור להוציא פירות מן הארץ לחו"ל היה משום הדאגה שלא יהיה מחסור בפירות הארץ. עתה, משהארץ משובחת בפירותיה, ומכל־מקום קיימת אפשרות לייבא פירות מחו"ל, והדבר מהווה כעין חילופין, פג טעמו של האיסור והדבר נעשה מותר¹⁰⁸.
