הנני מרשה לעצמי לפנות לכת"ר להודיע לנו מה הן האפשרויות הניתנות ליהודי בן־עירנו הרוצה לעלות לישראל בתור תייר הוא ומשפחתו כדי לחוג את חג בר־המצווה של בנו בירושלים תובב"א. כפי הנדר שקבל עליו זה כמה שנים.

הילד לא נמלאו לו עוד השלש עשרה שנה כי הוא נולד שלשה ימים לפני ראש השנה בשנת תש"ו והוא רוצה לחוג את חג הבר מצווה בפרשת "עקב" אם ירצה ה' בזה בט"ז באב ש"ז.

אולם יש שהפוסקים שכתבו שאין להקדים קיום הנדר. וזה שנדר לחוג את שמחת הבר־מצוה של בנו בירושלים, מסתמא הכוונה על הכנסו לשנת הי"ד בדין. ואם יקדים להניח התפלין ולשמוח שמחת המצוה לפני הזמן – לדעתם של פוסקים אלה לא יוצא ידי חובת נדרו אלא אם כן ישהה בירושלים עד יום הכנסו לשנת הי"ד ויעשה גם אז שמחה¹²⁰.

את מכתב יד קדשו קבלתי לנכון והנני מודה לו מאד על זה. אולם אחרי חקירה אצל הנודר, הוברר, שאפילו בשעה שנדר, כונתו היתה בפירוש לחוג את שמחת בנו כשני חדשים לפני הכנסו לי"ד, והסבה לזה היא פשוטה, מר דניאל עלוש – כך שמו, סוחר בלבושים מקצועו. ורוב עסקו הוא עם הילדים מכל גיל. וחדשי ספטמבר ואוקטובר הם אצלו כחדשים של יריד, מחמת פתיחת בתי הספר של העיר. ולכן מעולם לא חשב לאפשרי בשבילו להעדר מעסקיו בחדשים אלה. ובכן נדרו לא היה ל"בר מצוה" מש אלא ל"חינוך" בעלמא. הוא חושב ג"כ בחזרתו לחוג את ה"בר מצוה" בעיתה בעירו.

מילא אין כאן לפי דעתי הפעוטה בית מיחוש לגבי מה שכתבו הפוסקים, הואיל ואין כאן נדר של חגיגת "בר מצוה" בירושלים כנ"ל, ולרווחא דמלתא הצעתי היא לעשות לו התרת נדרים לצאת מידי כל ספק.
