איזה חידושים נתחדשו בישראל בענין זכותה של האשה לדרוש גט פטורין מבעלה? לתמהוני לא מצאתי באנציקלופדיה התלמודית שום רמז לחידוש. לפי עניות דעתי ישנם מקרים שבהם האשה יכולה לדרוש מבעלה גט פטורין.

לפני בא מקרה זה: האשה טוענת שבעלה נואף עם אינה יהודית ואין לה אלא הוכחות חשד. בכלל אין שום תקוה שתוכל להמשיך לחיות עם בעלה. וזה אינו רוצה לגרשה אלא אם יתנו לו סכום כסף גדול.

בהמשך למכתבי מיום ו' מרחשון באתי להוסיף שבנדון שאלתי נודע לי שיש עדים שהבעל חי עם אינה יהודית. במקרה זה חושב אני שיכולים להכריח את הבעל לגרש את אשתו. אבל כיצד מכריחים אותו?

בדבר שאלתו על אשה שטוענת טענת "מאיס" משום שבעלה חי עם אשה אחרת ויש עדים כשרים שמעידים שיש לבעלה יחסים עם אשה אחרת, אם יכולים לכופו שיפטרנה בגט?

בטענה זו אין כופין את הבעל לגרש, אבל בית־דין פוסקין לה מזונות כפי יכולתו, ויש שסוברים כי אפשר להטיל עליו מזונות יותר מכפי יכולתו עד שיפטרנה בגט¹⁵⁸.
