הואיל והמבקש לא הוכיח בפני ביה"ד האזורי בעדים כשרים שאמנם נשא את האשה הנ"ל בנישואין אזרחיים בלבד, והואיל ובתשובת ביה"ד דבודפשט אף לא נרמז על־כך, הרי שיש לדון בבקשתו בחזקת נשוי בחו"ק כדת וכדין.

מכאן שמוטלת החובה על הבעל־המבקש להוכיח שאכן אשתו סרבה לעלות עמו ארצה ועמדה בסירובה כל הזמן. דבר שלא הוכח כלל וכלל, לא במסמכים ולא בעדים.

אמנם ביה"ד האזורי בת"א פנה לביה"ד בבודפשט בקשר לבקשה זו, אולם השאלה שהופנתה לבי"ד זה, היתה לברר אם האשה מסכימה לקבל גט בלבד. וביה"ד בבודפשט השיב שהאשה מסרבת להופיע בבית – הדין, ולא נתנה כל סיבה לאי־הופעתה.

מתשובה זו עדיין אין להסיק שהאשה מורדת היא, שיתכן שאין ברצונה להתגרש מבעלה. ואולי מסיבה זו סירבה להופיע בבית־הדין, או מטעמים אחרים שהמצב גרמם, ובדעתה לעלות ארצה לכשיאופשר הדבר.

אמנם ה"עין יצחק" בח"א אה"ע סי' ג' בנידון דידיה שהבעל טען ברי שאשתו מורדת בו ונתקבלה עדות של עד אחד על־כך – התיר לו לישא אשה על אשתו, משום שהיו אומדנות והוכחות המסייעות לדברי הבעל והעד.

אולם במקרה זה אין מעין אותן אומדנות והוכחות שכתב בעל "עין יצחק", וגם לא עד אחד. גם אין הענין שלפנינו דומה לנדון דבעל "קרית מלך רב" ח"א בשו"ת שבסוף הספר סי' י"ג, עיין שם.

הנה ה"חלקת מחוקק" ו"בית שמואל" בסי' קי"ט ס"ק ז כתבו שבשבויה – אין להתיר לבעל לשאת אשה אחרת. ועיין בתשובת "צמח צדק" סי' א' וב"עבודת הגרשוני" סי' נ"ג, שבנשבית אף אם משום מצוות פריה ורביה לא התירו. ובתשובת "שב יעקב" כתב כי לא נוהגים להתיר אלא בנשתטית, אבל בענין אחר לא נשמע מעולם להתיר לישא אשה אחרת. ועיי' "ברית יעקב" סי' א'.
