קבלתי אגרתו מיום ד' בחודש זה ובו כותב כת"ר שבעתוני אמריקה וקנדה הופיעה ידיעה חדשה שהרבנות הראשית לישראל עשתה מעשה רב ריפורמה בדת והתירה לאשה שזקוקה לחליצה להנשא בלא חליצה, ומקוים שהרבנות תוסיף ללכת בדרך זו ותעשה צעדים קדימה לתקן הדת וכו' וכו'. ומר התרתח בריתחא דאורייתא על לא טובה שמועה זו, וכתב מה שכתב. לזאת אשיב שהעתונים בארץ ובחו"ל לא הסתפקו באמת שבשמועה זו, אלא הוסיפו וגרעו כמנהגם וכדרכם.

גופא דעובדא הכי הוה: הובא בפני בית־הדין הגדול בירושלים, שהיה מורכב משלושה רבנים מגדולי הרבנים בארץ, והם: הרב יוסף אלישיב, אב"ד, הרב בצלאל זולטי והרב אליעזר גולדשמידט חברים עמו. ענינה של אשה צעירה אשר הייתה עם בעלה המנוח ימים אחדים ולבעלה לא היה כח גברא וישנה תעודת רופא המאשרת מצבו של בעלה. האב"ד הרב יוסף שלום אלישיב כתב פסק־דין באריכות רבה להתירה וחתמו עמו שני חבריו. היות והיה ידוע להם שב"אגרות משה" להרב משה פיינשטיין דן בעובדא מעין זו שלחו אליו פסקם והצטרף עמהם להתירה בלא חליצה¹⁵⁹.

לרבנות הראשית לא נודע ממעשה זה, עכ"פ לי עצמי לא נודע מזה לפני פרסום המעשה בעתונות, והעלימו זה ממני, ואולי בצדק, לפי שיודעים שאין אני מתערב בעניני גיטין וחליצה. נוסף לכך גם ידעו שאין אני מאמין ברופאים שבארץ ובתעודותיהם. מפגישותי עם גדולי הרופאים פה בקשר עם ענין המדהים והמצער של ניתוחי מתים, נוכחתי שאין לסמוך עליהם בדברים הקשורים בהלכה.
