אני החו"מ מבקש מכבודו שאלה ותשובה עליה. בשבוע שעבר קראתי בעתון מאמר על השגריר האמריקאי היה אצל כבודו בקש ממנו ללמוד חומש עם פירוש רש"י ועוד תלמוד בבלי. רציתי לשאול מעלת כבודו לא נעלם המאמר שכתוב במסכת סנהדרין דף ע"ח ע"ב כותי שלמד תורה חייב מיתה, איך מעלת כבודו מרשה לו ללמוד? ועוד בזמן מתן תורה הקב"ה הציע את התורה לבני ישמעאל וסרבו לקבל אותה וגם בני עשו סרבו לקבל אותה אלא דוקא ישראל ואיך מעלת כבודו מרשה לו ללמוד את התורה? אני מבקש תשובה ברורה והיתר על זה.

בימינו התנ"ך והתלמוד מתורגמים ללשונות העמים, ומקצועות היהדות נלמדים במכללות מפי כמרים ואנשי מדע שאינם בני־ברית. מכאן שהאפשרות ללמוד תורה אינה תלויה במלמד יהודי בלבד.

כמה פוסקים קבעו שמותר לישראל ללמד את לשון הקודש ודקדוקה – לכמרים, וממילא יוכלו ללמוד תורה אף בלשוננו.

הרמב"ם בתשובותיו סי' שז"ד קובע שלגבי הנוצרים ישנה אפשרות ללמדם לפי ש"הערלים מודים בנוסח התורה כי היא בשלמותה כמו שהיא בידינו רק יגלו פנים בפירושים מופסדים וירמזו בה הרמזים הידועים להם ואם יעמידם איש על הפרוש הנכון אולי יחזרו. ואם גם לא יחזרו אין בזה מכשול לישראל, כי לא ימצאו בתורתם הפך תורתנו".

במסכת חגיגה דף י"ד עמ' א' נאמר: "אמר ר' אמי אין מוסרין דברי תורה לגוי שנאמר לא עשה כן לכל גוי". התוספ' במקום הקשו מה בא להשמיענו ר' אמי שהרי בלאו הכי אסור לגוי ללמוד תורה כמבואר בסנהדרין נ"ט, וממילא המלמדו עובר על "לפני עיור", ותרצו שהמדובר במקום שיש גוי היכול ללמדו, שאז ישראל המלמדו אינו עובר על "לפני עיור", – אבל יש איסור משום "מגיד דבריו ליעקב".

המהרש"א במקום כותב שהאיסור הוא ללמדן טעמי המצוות וסודותיהם, אבל סתם לימוד – אין איסור. וכן כתב ה"באר שבע" בקונטריס באר מים חיים סי' י"ד, וציין שיש רבנים המלמדים תורה לעכו"ם.

ועל עיקר הדברים שבמסכת סנהדרין שכותי שלמד תורה – חייב מיתה, כותב הרמב"ם בתשובותיו סי' שס"ד שהמדובר הוא כשידינו תקיפה עליהם שאז יכולים למנוע אותם מללמוד.

ובשו"ת "בשמים רא"ש" סי' שכ"ז מובאת שאלה שהופנתה לרא"ש מרב אחד שרצה ללמד תורה לנכרי והיה נראה לו כי עתה אין איסור בזה באשר האיסור הוא משום שאסור לגוי ללמוד תורה והמלמדו עובר על "לפני עיור לא תתן מכשול". ואילו עכשיו לא שייך איסור זה של "לפני עיור" הואיל ויש הרבה כמרים היודעים תורה – ויכולים הם ללמדם לנכרים.

והשיב הרא"ש כי אין הדין עמו של השואל, והוא אומר: וכי הכומר היודע ללמד מצוי הוא? ומי שילמד תורה ממנו רואה סימן יפה במשנתו? בלי ספק, לו היה לו נוח ללמוד אצל הכומר לא היה בא ללמוד מפי הרב השואל – ולכן הכריע הרא"ש שאסור לרב ללמדו.

אבל בימינו ידוע שהתנ"ך, רש"י והתלמוד תורגמו ללשונותיהם ומצויים לרוב כמרים ואנשי מדע שאינם בני ברית הלומדים תורה ומלמדים אותה – ולאור דברי הרמב"ם הנ"ל שלגבי הנוצרים אין יוצא מזה מכשול – ולא עוד אלא שפוסקים התירו לישראל ללמד לנכרים לשון הקודש ודקדוקה, אף שדבר זה ממילא יכול להביאם ללימוד התורה (ראה "ויאמר יצחק" – או"ח סי' כ"א; ו"מעשה אי"ש" – להראש"ל ר' יעקב שאול אלישר זצ"ל – חלק יו"ד סי' ז').
