שאלת סיוע או הדפסה או מכירה של ספרי חשק. כבר נפתחה בראשונים. עיין למר"ן בשו"ע או"ח סי' ש"ז סעי' ט"ז. ועי"ש שסיים: "ואין צריך לומר המדפיסן, מחטיאים את הרבים". ע"ש בביאור הלכה. ועיין במשנה ברורה (ס"ק סא) שהביא את סברת מחנה־חיים. שאסור להסתחר בהם. (ויש לעיין עוד בתוס' שבת קט"ז סוף ד"ה וכ"ש וכן עיין להרא"ש משם ה"ר יונה ז"ל בפרק שואל סוף סי' א') וכן כותב הצפנת־פענח סי' רע"ו. שהמוכר עתונים חפשים עובר משום לפני עור לא תתן מכשול. וכן עיין למורינו הגרי"ח בספרו רב־ברכות מערכת צ' בסופו מה שהאריך בענין תמונת נשים והפצת התמונות.

למעשה יש בזה איסור של מסייע ביד עוברי־עבירה. או לאו של לפני עור לא תתן מכשול. ועיין ע"ז ו: וכן עיין שם תוס' ד"ה מנין, שמשמע שאם לא קאי בתרי עברי נהרא מותר לסייעו מפני שיכל לקחת בעצמו. (וכן בענין הדפסת הספרים וסחורה בהם יהיה לכאורה מותר אם יש אחרים המדפיסים ואין הוא המדפיס היחידי), אך עיין שם בהר"ן ד"ה מנין, שכתב ומ"מ מדרבנן מיהא אסור, שהרי מחוייב הוא להפרישו מאסור ואפילו מיירי שהיה יכול ליטלו... דלא עבר משום לפני עור... ומוקי לה בפ"ק דע"ז דקאי בתרי עברי דנהרא, מכל מקום אסור מדרבנן. וכן כתבו התוס' שבת ג. ד"ה בבא דרישא. וז"ל... והיאך יסייע ביד עוברי־עבירה, ע"ש, שמשמע אף אם לא קאי בתרי עברי נהרא, מ"מ איסור דרבנן מיהא איכא שחייב להפרישו מאסור, ע"ש (ועיין בתוס' מציעא ע"ה: ד"ה ערב, ששם איירי על לאו מדאורייתא והרמ"א ביו"ד קנ"א סוף סעיף א' הביא בזה מחלוקת, ועיין שם בש"ך ס"ק ו' מה שהאריך. וכן עיין שם בבאורי הגר"א אות ח'. ומה שהביא הגר"א מנדרים ס"ב, עיין בזה להחיד"א בשיורי ברכה שם באורך. וכן עיין ביד מלאכי סי' שס"א.

בע"ז נ"ה מובא שם במשנה, ישראל שהוא עושה בטומאה, לא דורכין ולא בוצרין עמו. אבל מוליכין עמו חביות לגת, ומביאים עמו מן הגת. ועיין שם ברש"י הטעם שאסור לדרוך עמו מפני שמסייע ביד עוברי־עבירה. והטעם שמותר להוליך ולהביא מהגת.

ועיין בהר"ן שם שכתב הטעם שמותר לסייע בהולכה לגת ובהבאה, מפני שמעשה העבירה כבר נגמר. ולכאורה הרי סוף סוף הוא מסייע ביד עוברי העבירה, וכמדומה לי שהמהרש"ם הסביר שהטעם הוא מפני שבעת הסיוע לא היתה שעת עשיית העבירה. ומזה למד שמנהל בית חולים ירא שמים מותר להשאיר פנקס רפואי פתוח מערב שבת שרופא ישראלי אחר ירשום בו שמות החולים ותרופתם בשבת, כי בעת הסיוע בפתיחת הפנקס לא היתה זמן ושעת העבירה.

וכל האסור רק אם מסייע הוא בגופו בהדפסה, או הוא מוכר או מסתחר. אך יתכן אם הוא רק משכיר לו כלי ובכלי הזה הוא משתמש לאסור יתכן דאין בזה משום מסייע, ובפרט שבעת פעולת ההשכרה או עשית השורות אינה שעת העבירה. ויש לעיין בדין השכרת כלים לשבת שו"ע או"ח סימן רמ"ו, ובדין השכרת כלים או חמור לפסח, ס' ת"ן סעיף ז'. (ועיין בהרדב"ז ח"א, תפ"ו) ונוסף לכך הרי הם הבטיחו וממשיכים להבטיח שהכל בסדר גמור ורק איתרע פעם אחת.

למסקנא. אם הענין הוא כמובא בשאלה בדיוק. אז אין חשש של מסייע. (ואין זה דומה למחנה־חיים), בתנאי שלא יכתב שֵׁם הדפוס על החוברת.

כב' שאלני אם רשאי לאפשר להוצאת ספרי רומנים לסדר האותיות בבית הדפוס שלו מבלי סיוע של כב' או של מישהו מטעמו. ואילו מלאכת ההדפסה והעימוד תעשה בבית דפוס אחר. אף שבודאי כבר מצא כב' פתרון לשאלתו, לא אימנע מלהודיעו חוות דעתי בנדון, בתכלית הקיצור.
