לחסום בפני הזרם הזה, גדר ותקן בזמנו מאור דורנו כמהר"ר ר' שאול סתהון ז"ל, וכאשר הובא בספרו "דבר שאול", שלא לקבל גרים כלל בארגנטינה. ואחריו בא מוהר"ר דוד סתהון ז"ל וחדש עוד פעם הגזרה והסכים אתו חו"ר וגאוני כמה ארצות אשכנזים וספרדים ועד היום הננו ממשיכים בתקנה זו בכל תוקף.

אחינו הדמשקאים הוסיפו לנקוט במגדר מלתא לענוש את המתבולל גם שלא לקברו בבית הקברות שלהם (עיין במהר"ם שיק יו"ד רמ"ט).

וגם אני השתדלתי ושכנעתי את הח"ק שלנו לנקוט באותו מגדר מלתא, וסברו וקבלו והכניסו אותו בהתקנון שלהם שאושר ע"י הממשלה ג"כ, אך במובן זה שכל הנשוי באופן רשמי עם אשה לא כשרה לו לפי תוה"ק אין קוברים אותו בבית הקברות של העדה.

מובן כי מדי פעם בפעם כאשר יקרה מקרה לא טהור מזה, קרובי המתבולל מרעישים עולמות עד שסוף סוף מוליכים את המתבולל וקוברים אותו בקברות של שאר העדות ע"י תשלומים סכומים גדולים.

וכעת בראותי שלא הועילו חכמים בתקנתם כי סוף סוף הם נקברים בקברות ישראל, ולא עוד אלא ששאר העדות מנצלים את ההזדמנות הזו לסחוט המון כספים מהם ומחלוקות גדולות צומחות עבור זה יום יום, והיות כי לא נעלם כי לפי דעתי אין כל אסור רק שלא לקבור אפילו רשע חמור אצל רשע קל.

לכן חושבני כי הגיעה השעה לשים קץ לכל התלאות האלה באופן כזה: לקבוע מקום קברות מיוחד להחטאים האלה שיהיה בתוך בית הקברות של העדה, רק מובדל ומרוחק ע"י גדר של אבנים וכיוצא, ובזה אולי יהיה להם יותר בזיון ועונש, שיהיו מצויינים לרעה שם, וכל העם יראו וייראו ולא יזידון עוד.

קבלתי את מכתבו מיום כ"ח בחודש כסלו על ידי שליחו בענין אימוץ הילדה הגויה ע"י משפחת כהן, שבקש כת"ר שאודיע לבית־הדין שיטפלו בגיורה. כבר הבעתי דעתי לכב' במכתבי הקודמים, שאין דעתי נוחה מאמוץ ילדים נכרים. בתי־הדין הרשמיים בארץ עמוסים עבודה ומוטרדים גם כן בשאלות הגיור של עולים נשואי תערובת ובניהם, ואיני מוצא לנכון להטרידם גם בעניני גיור של בני חוץ־לארץ.

בענין שאלת קבורתם של נשואי תערובת בבית קברות של יהודים, שכב' רוצה ליחד להם מקום בהפסקת כותל, יתכן הדבר אם יהיה מרחק ניכר בין הכותל לקברות משני הצדדים, וע' תשובת הרמ"ע מפאנו סי' מ"ד שכותל לבד אינו מספיק³⁸. גם ראוי להגביה את הכותל ככל שאפשר. בפרישת שלום לכ"ת ולבני קהילתו.
