בן שנולד מנישואי תערובת, דהיינו שהאיש יהודי והאשה לא־יהודיה שלא נתגיירה – בין שנישאו בערכאות ובין שלא נישאו כלל – אין לו דין של בן ליהודי, אלא הוא בנה של הלא־יהודיה והרי הוא כמותה. ולשם גיורו צריך מילה וטבילה כדין כל הבא להתגייר. אלא שבמקרה זה שהוא קטן, יש צורך בהסכמת אמו לגיירו. עכ"פ אם אין האם מסכימה להתגייר – אין טעם לגיירו בלעדה אפילו אם רצונה בכך, משום שהיא עלולה לגדלו ולחנכו לפי רוחה ודתה ולהאכילו דברים אסורים ועוד. אמנם יש אפשרות למולו שלא לשם גרות כדין שנהגו למול לא־יהודים. אך לא בשבת ולא בבית הכנסת אלא בבית או בבית חולים, ובלא ברכות²³.
