זה כבר כמה שנים שיש לנו חזן בשם ... והוא אין לו שום סמיכה לא לרבנות ולא לסדר גיטין, רק קבלנו אותו לחזן מפני שיש לו קול נעים.

זה כמה פעמים שהוא עושה גיטין שלא כפי ההלכה, כי אין לו שום סמיכה על זה. והוא טוען שהוא יודע לסדר גיטין, ואף כי אין לו סמיכה הוא רשאי לעשות גיטין, **כי הגיטין יכולים לעשות בלי סמיכה**.

אנחנו נמצאים במצב קשה, כי כל הרבנים של קאראקאס אומרים לנו שהחזן ... אם אין לו סמיכה הוא לא רשאי לסדר גיטין, והחזן טוען שכן יכול לסדר גיטין. מפני זה אנו פונים אליכם, כי אין לנו ברירה אחרת, אחרי שאין לנו בויניסואלה רב ראשי לשאול על הנדון.

קבלתי את מכתבו מיום ה' בחדש זה ונצטערתי לשמוע על עזות החזן שבקהילתכם שמהין לסדר גיטין כשאין בידו כתב סמיכה לכך, ומפני חומרת הענין הנני ממהר להשיב בקיצור.

משורת הדין צריך שיהיה בית דין של שלושה בסידור הגט, וכמו שנוהגים בארץ ישראל ובטורקייה ובכמה מקומות⁵⁴. ובמקום שאי אפשר בשלושה, ומסדר גיטין אחד, צריך שיהיה זה האחד בקי ומוכר כתלמיד חכם גדול בתורה ומומחה ומוסמך לסדר גיטין. ומה שאומר זה החזן שלכם שאין צורך בסמיכה, דבריו דברי הבל ורעות רוח, וכל עוד שלא יעמוד לבחינה בפני רבנים גדולי תורה ומומחים לסידור גיטין ויסמכוהו, אסור לו לסדר גיטין⁵⁵. ואם לא יציית הרי זה יקרא עבריין ומרבה ממזרים בישראל, ואסור לו להיות שליח ציבור.
