היא התחתנה ברומניא עם אדם אחד בשם ל.ק. בנישואין אזרחיים בלבד. הוא סרב לסדר חו"ק מחמת היותו כופר בעיקר ופורק עול התורה והיהדות. הם עלו שניהם לארץ וגם כאן סירב לסדר חו"ק מאותו הטעם. הוא נמנה על המפלגה הקומוניסטית הידועה לשמצה.

החיים ביניהם לא היו טובים ועל כן גמרו להיפרד ומרצונם נכנסו לביה"ד סיפרו את כל הענין ואת הסכמתם להתגרש כדי שיוכלו לתקן את מצבם האישי ונתגרשו מרצונם.

אחרי הגט היה מצבה של האשה קשה מנשוא, היא פשוט רעבה ללחם. היא הכירה איש פלוני והוא כהן ונכנסה לגור אתו והעניינים התפתחו עד לכדי כך שהיא כבר ילדה לו בת.

רצונה של האשה לחיות חיי משפחה כשרים וגם לשמור על טהרת המשפחה, ורצון שניהם לסדר חו"ק כדי שיוכלו לחיות כחוק וכדת. ומתעוררת השאלה, מה דינה של האשה הזאת לגבי אותו הכהן בזה"ז? הואיל והנישואין הראשונים עם ק. לא היו דתיים ולפי הדין לא היו צריכים גט והגט סודר מטעמים פורמליים – לשם סדור רשמי של תעודת הזהות – ורק מרצונם הם ללא החלטה מחייבת של ביה"ד. האם יש מקום לומר שאין כאן אפילו ריח הגט והיא מותרת לכהן, ומכ"ש שזה כבר בדיעבד ולא לכתחילה. האם יש בנדון דידן לסמוך על דברי הגה"מ המובאים בבאה"ט באהע"ז סימן ו' ס"ק ה' ד"ה בעלמא? נוסף לזה הרי האשה רוצה לחזור בתשובה ולקבל על עצמה לנהוג מהיום בחיי משפחה טהורים וכשרים, הרי שיש לומר מוטב שיאכלו וכו'.

באשר לשאלתו אם מותר לגב' ע.ק. להינשא לכהן, לאחר שקבלה גט ממי שנישאה לו בנישואין אזרחיים – אין אנו מוצאים כל צד להקל בנדון זה.

על האשה היה להודיע בשעתו לבית־הדין שהיא חפצה להנשא לכהן ויתכן שביה"ד היה רואה מקום שלא לחייב מתן גט, דבר שהיה מאפשר להינשא לו.
