הנני מבקש לענות לי בשאלתי הערוכה כאן בענין דלקמן: באחד הישובים בסביבתי בא לפני אחד מחברי הישוב הזה, קיבוץ מכובד, שגם כת"ר בקר בו פעם.

המקרה הוא שהוא עם בת זוגו מוכרים כאיש ואשתו והוא מהמכובדים בקבוצה, אולם הם לא נישאו כדת. הם באו מרוסיה לפני כעשרים וחמש שנים ויש להם בן שנולד בישובם זה, הוא בן עשרים שנה ומעלה.

והנה האדם הזה בא ומתודה לפני שאני מכיר אותו משנים רבות כאדם חשוב, וספר לי שמעיק עליו הדבר שלא נשא אשתו זאת כדת משה וישראל עקב רוח הרעה שהיתה קימת בארץ מוצאו רוסיה, שרבים היו חללים שנפלו בעטיה להתפרקות, והיתה מהלכת בקרב רבים, לקיים משפחה באהבה חפשית, כך קראו לה.

כעת הוא רואה מועקה נפשית על מה שעבר, ומבקש לקדש אשתו זאת כדת משה וישראל. לכן למען אדע לכלכל מעשי בנדון, הנני פונה לכת"ר להמלך ולקבל הוראת תורת פיהו במענה רצון בהקדם, כדי למלא בקשת הזוג להכניסם בברית הנשואין כדת וכדין.

קבלתי מכתבו מיום ח' בחדש זה. בענין שאלתו, יש צורך לברר אם מעיקרא היו מותרים זה לזו, כיון שזה דרכם היה לקיים משפחה באהבה חופשית, כפי שכב' כותב, א"כ אפשר שיש ביניהם שקיימו משפחה גם עם אסורות. לכן צריך שתגבה עדות בבי"ד שבאזור, שאין בנדון חשש כזה, ואח"כ ימלא כב' את מבוקשם ויסדר להם חו"ק [חופה וקידושין] כדת וכדין.
