דין הוא שרשאי אדם לעשות בנכסיו כטוב בעיניו וליתנם במתנה לכל שירצה, כשהוא בריא ע"י קנין וכשהוא שכיב־מרע אף שלא ע"י קנין. אלא שרשאי הוא לעשות זאת בלשון מתנה ולא בלשון ירושה. שהלכה מפורשת ומוסכמת היא שאין אדם יכול להוריש מנכסיו כלשהו למי, שלפי חוקי התורה, אינו "יורש".

הלכה זו נפסקה בש"ס ובפוסקים⁹⁶ והרמב"ם⁹⁷ מסכמה כך: "אין אדם יכול להוריש למי שאינו ראוי ליורשו... לפי שנאמר בפרשת נחלות והיתה לבני ישראל לחוקת משפט. לומר שחוקה זו לא נשתנית ואין התנאי מועיל בה. בין שצוה והוא בריא בין שהיה שכיב־מרע, בין על פה ובין בכתב – אינו מועיל".

ברור, איפוא, שאין בית־דין מוסמך ליתן צו המנוגד להלכה. הפתרון לשאלה זו הוא שבצו האימוץ לא ישתמשו בלשון ירושה אלא בלשון מתנה, כגון דא: הילד המאומץ יקבל במתנה חלק מירושת המאמץ כאחד מבניו.

מהאמור לעיל יש להסיק ברורות שאין בית־דין, הדן לפי דיני ישראל יכול להכיר בצו־אמוץ, שבו ניתנה זכות ירושה למאומץ ע"י בית משפט מחוזי. העומד בסתירה לחוקי התורה.

אמנם יש מן הפוסקים אשר דנו בשאלה זו מן הטעם של "דינא דמלכותא דינא"⁹⁸. אך מסקנתם היתה שאין להתחשב במקרה דנן בטעם זה. ראה שו"ת "גבעת־עולם" סי' י"ז⁹⁹.

כמובן כל השקלא וטריא הזאת אין לה ענין במדינתנו כיום, שכן הכלל הזה אינו יכול להיות מחייב במדינה שיש בה שלטון יהודי רבוני וששופטיה אינם שופטים לפי דיני ישראל¹⁰⁰.
