בזמן האחרון הובאה לארץ מפולין כמות של אפר מאפרם של קדושי השואה הי"ד, ונתעוררה השאלה היכן יש לטמון אפר זה.

היות ואפר הקדושים שהועבר ארצה לפני כן הוטמן בפומבי בהר־ציון, מן הראוי שהאפר הנדון יובא אף הוא לקבורה בהר־ציון, בכדי למנוע פיצול במקומות הקבורה ולאפשר ריכוזו של האפר במקום אחד.

אמנם מדברי התוספתא בפרק ו' [הלכה ב] דנגעים ומהרמב"ם בהלכות "בית־הבחירה" פ"ז הי"ד, אשר כתבו שאין מקיימים קברות בירושלים חוץ מקברי מלכי בית דוד וקבר חולדה הנביאה שהיו שם מימות הנביאים הראשונים – משמע שהר־ציון יש לו קדושת ירושלים, ואין לקיים בו קברות מחוץ לקברי מלכי בית דוד, אולם הואיל ואין כאן אלא אפר גרידא – הרי זה מותר. ועיי' הרדב"ז ח"ב סי' תרל"ג ומהרימ"ט יו"ד ח"ב סי' ל"ז וחסדי דוד ח"ב דף ב'¹⁰¹.

והואיל, וכאמור, הוטמן האפר הקודם בהר־ציון, אשר נוסף לקדושה שלו כשלעצמו קרוב הוא להר־הבית ולהר־הזיתים, הרי תהיה זו פגיעה בקדושים שלא יטמנו במקום זה אלא במקום אשר אין בו אותה קדושה.

לאור האמור לעיל החלטנו שיש לטמון את אפר הקדושים בהר־ציון באותה חלקה שבה נטמן האפר שהובא לפני שנים מספר.
