נתקלתי בימים האחרונים בשאלה הלכתית שהנני מביא אותה בפני מכת"ר.

בשבי־ציון ע"י נהריה נמצא ספר תורה פסול אשר נקרע בזמנו ע"י הנאצים ימ"ש בגרמניה, ואשר הובא על ידי אחד מאנשי הקהילה שם ארצה. המועצה המקומית בשבי־ציון, המורכבת מיוצאי גרמניה, הקימה בית תרבות במקום ומתכוונת להכניס את ספר התורה הזה לתוך ארון מזכוכית ולהעמידו בתוך בית התרבות. השאלה היא אם עלי למחות נגד התכנית הזאת ולנסות למנוע את הצגת ספר התורה שם, או אם נמצא היתר לדבר הזה?

בגמרא מגילה כ"ו: אמר רבא ספר תורה שבלה גונזים אותו אצל ת"ח וכו'. ולפי זה פוסק הרמב"ם הלכות ספר תורה פ"י הלכה ג' שספר תורה שבלה או נפסל נותנים אותו בכלי חרש וקוברים אותו אצל ת"ח וזוהי גניזתו. גם הטור והשו"ע יו"ד סימן רפ"ד פסקו לפי נוסח הרמב"ם. ומדברי הרמב"ם המוסיף את המילים: "וזוהי גניזתו", שאינן כתובות בגמרא, יוצא לכאורה שאין דרך אחרת של גניזה אלא קבורה.

מאידך מחזיקים במרתף השואה ירושלים אפר קדושים וגם חלקי ספרי תורה שנמצאו ע"י הרוצחים מבלי להביאם לקבורה. אולי אפשר להסתמך בהיתר על הגמרא בתענית ט"ז. נותנים אפר מקלה במקום תפילין וכו', ופרשו שם תוספות שהאפר הוא מדבר הנשרף מעצמות אדם כדי לזכור עקדת יצחק, ולכאורה קשה איך משיגים אפר מעצמות אדם שהם טעונים קבורה?

אלא אפשר להסביר את הדבר שמדובר שם בעצמות של אחד מקדושי ישראל והחזיקו באופן מיוחד בעצם אחד או בעצמות הללו כדי לזכור את עקדת יצחק ולעורר את הזעם נגד הרוצחים. הטעם הזה ניתן להאמר גם במקרה של ספר התורה בשבי־ציון הואיל וכל כוונת התושבים שם היא להזכיר לנו את אשר עשה לנו עמלק.

כב' מהסס שמא צריך קבורה, כמו שנאמר בש"ס: "ס"ת שבלה, גונזין אותו אצל ת"ח", וכן פסקו הפוסקים ועל זה ביקש את חוות דעתי.

הריני להשיבו, כי אותה גניזה האמורה בש"ס ובפוסקים אינה חובה ולא דוקא אלא כדי שהס"ת לא יושלך ויתגלגל בבזיון ח"ו.

מה שעלה בדעת חברי המועצה להשים את הס"ת שנפסל בארון של זכוכית, הרי זו עצה טובה, בתנאי שאין משתמשין בבית התרבות למטרות שאינן לכבוד הס"ת, כגון ריקודים וחלולי שבת וכדומה¹⁰².
