המנוח אבי נפטר בגיל 90, הוא היה למדן בתורה ותלמיד חכם גדול. בשנת 1949 יום לפני פטירתו צוה עלי המנוח אבי לקיים את דבריו, ולא רצה לעצום את עיניו עד שלא הבטחתי לו לקיים את דבריו, וכך אמר:

אחרי פטירתי תקבור אותי באופן זמני בת"א, ולאחר שיהיה פתוח הר הזתים תקברו אותי שם ליד אשתי, באותו רגע הצטרפה אשתי ואמרה לו אבא הרי אתה יודע שהר הזתים לא נמצא בידנו ואתה כל יום קורא ... ומתמצא במצב הקיים, איך אתה דורש שנקבור אותך באופן זמני בת"א. המנוח אבי רצה נוסף לדבריו בע"פ גם תקיעת כף לאות הסכמה, אח"כ החליט ואמר: לא אתן לך יד אני אסתפק בדבור וזו לשון צואתו:

אחרי 8 שנים לפטירתו הגיע אחי הגדול הרב יחיאל מקסימוב מרוסיה שהינו רב חזן מוהל ודרשן. ספרתי לו את צואת אבי הנ"ל, אמרתי לו אחי! אבא עשה לי צואה כזו, אתה בתור רב מלומד מה תיעץ לי לעשות? לאחר ששמע את פרטי הצואה אמר לי אין אנו יכולים לשנות שום דבר, צואה זו צואה ואין להפר אותה.

אחי השתקע בארץ בשכונת שפירא, קבל משרה בביה"כ בתור רב של שכונת שפירא חזן דרשן ומוהל. לפני שנה יום אחרי האזכרה של אבי באופן פתאומי נפל אחי למשכב קבל שתוק בחצי גופו ומחלת השכחה בראש.

לפני כשנה ביום אזכרתו של אבי ז"ל באותו לילה נראה אבי בחלומי ובקש ממני לקבור אותו בירושלים להוציא אותו מתוך הארגז אשר קברו אותו אז בתל אביב. ומאז אני נמצא ביסורים קשים. קבלתי שטף דם בראש. ומצבי היה קשה. כל ימי עוברים עלי בבכי, ומאז אותו יום לא זזה דמותו של המנוח מעיני. לפני כעשרים שנה בזמן מלחמת השחרור חלה אבי לפתע ולפני מותו ציוה על אחי הצעיר שיקברו אותו ליד אמי ז"ל שהיא קבורה בהר הזיתים בירושלים. לכן אנו מבקשים ממך כבוד הרב לאפשר לנו לקבור את המנוח בירושלים, ולא דוקא בהר הזיתים שנמצא ליד הערבים כידוע. ואחי מסרב לבקשתי בטענה שאם כבוד הרב יאפשר לו זאת, הוא יהיה מוכן. אנא רחם עלי, כי חיי הם לא חיים. לפני מחלתי הייתי חזן. רב. מוהל. שוחט. ודרשן. והיום נפלתי למשכב. תודה למפרע.
