הלכה ידועה היא שאין קוברים רשע אצל צדיק (עיין שו"ע יו"ד סי' שס"ב ס"ה), אמנם בשו"ע לא נתבאר שעור ממרחק שצריך להיות מפריד ביניהם. אולם בגליון מהרש"א שם כתב שצריך להיות המרחק ביניהם יותר משמונה אמות, משום דבעינן שלא תגע תפיסת הרשע בתפיסת הצדיק, ושעור התפיסה ידוע שהוא ארבע אמות (עי' שו"ע סי' שס"ז). וכן נראה מתשובת "אמרי יושר" ח"ב סי' נ שצריך להרחיק יותר משמונה אמות, וכן כתבו בתשובת "מנחת אלעזר" ח"ב סי' מ"א ו"משמרת שלום" – במערכת ק'. וסיים במשמרת שלום ולפי זה עתה שבעוונותינו הרבים נתאחו הקומוניסטים ר"ל צריך להרחיק מקבורתו יותר משמונה אמות מכל צד משאר מתי ישראל הכשרים. וב"הדרת קדש" דף ל"ד כתב דאפשר נמי ברחוק ארבע אמות וכותל מפסיק בגבה ארבע אמות. ובתשובת הרמ"ע בסי' מ"ד מבואר דכותל לבד אינו מפסיק¹¹⁶.
